Semiconductor integrated circuits are often traded in internationally.

In light of this, the Treaty on Intellectual Property in Respect of Integrated Circuits (the Washington Treaty) was adopted on May 26, 1989, by the World Intellectual Property Organizaion (WIPO). The Washington Treaty has not come into effect yet. However, some of the provisions are applied to Article 35 of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs). Thus, basically all the member countries of the World Trade Organization (WTO) are under obligation to protect semiconductor integrated circuits.

More than a few countries have adopted a registration system for semiconductor integrated circuits. Let’s have a look at the situations in some of those countries. Please note that there is hardly any difference among the countries with regard to basic protection systems, matters to be contained in an application for registration and documents to be attached to the application.

(1) US

In the United States, applications for registration must be filed with the United States Copyright Office. Four actual semiconductor integrated circuits need to be submitted.

Also, it is required that the unique part of the circuit layout be explained in the application for registration. Registered semiconductor circuit layouts can bear the “mask work” mark and the codes below. In addition, the name of the grantee or the initials thereof can also be shown on the circuit layout.

The term is ten years from the date of its registration, i.e. the date of receipt of the application for registration. A registration certificate is issued five months or so after the date of registration.

(2) Canada

In Canada, applications for registration must be filed with the Canadian Intellectual Property Office. Four actual semiconductor integrated circuits need to be submitted. Also, it is required that the unique part of the circuit layout be explained in the application for registration.

The term is ten years from the filing date. It takes two to three weeks to go through the procedure from application to registration. A registration certificate is issued one to two months or so after the date of registration.

(3) Germany

In Germany, applications for registration must be filed with the German National Patent Office. One actual semiconductor integrated circuit needs to be submitted. Also, it is required that the circuit layout be briefly explained in the application for registration.

The term is ten years from the date of the first transfer or the like of the semiconductor circuit layout. It takes about a year and two months to go through the procedure from application to registration.

(4) France

In France, applications for registration must be filed with INPI (l'Institut National de la Propriete Industrielle). One actual semiconductor integrated circuit needs to be submitted. Also, it is required that the circuit layout be briefly explained in the application for registration.

The term is ten years from the filing date or the date of the first transfer or the like of the semiconductor circuit layout. It takes one to two months or so to go through the procedure from application to registration. A registration certificate is issued one to two months or so after the date of registration.

(5) China

In China, applications for registration must be filed with the State Intellectual Property Office of the People's Republic of China. Four actual semiconductor integrated circuits need to be submitted. Also, it is required that the circuit layout be briefly explained in the application for registration.

The term is ten years from the filing date or the date of the first transfer or the like of the semiconductor circuit layout. It takes two to three months or so to go through the procedure from application to registration.

(6) Taiwan

In Taiwan, applications for registration must be filed with the Taiwan Intellectual Property Office. Four actual semiconductor integrated circuits need to be submitted.

Also, it is required that the circuit layout be briefly explained in the application for registration.

The term is ten years from the filing date or the date of the first transfer or the like of the semiconductor circuit layout. It takes about five months to go through the procedure from application to registration. A registration certificate is issued two months or so after the date of registration.

(7)South Korea

In South Korea, applications for registration must be filed with the Korean Intellectual Property Office. After revision of the law on October 28, 2007, the online registration became available. You may also file written applications as usual.

No actual semiconductor integrated circuit is required to submit. Only the drawings as the circuit layout design files (computer-readable file format) are required to submit.

In a circuit layout description form submitted with the applications, the name of the circuit layout, classification, and the brief explanation should be stated. In addition, a seal registration certificate of the representative who was affixed his/her seal to the letter (Power) of attorney and a corporation nationality certificate (a certified copy of the corporate registration) of the applicant must be submitted.

The term is ten years from the date of registration which is the date of receipt of the registration. A registration certificate is issued two month or so after the date of registration.
