일본-태국 간 및 일본-인도네시아 간 특허심사 고속도로 시행 프로그램의 기간 연장
2023년 12월 31일에 종료 예정인 일본-태국 간 특허심사 고속도로(PPH) 시행 프로그램 및 일본-인도네시아 간 PPH 시행 프로그램 실시 기간이 모두 연장되었다.
구체적으로 일본과 태국 간의 PPH 시행 프로그램의 실시 기간은 2025년 연장되며, 종료 예정일은 12년 31월 3일이다. 또한 일본-인도네시아 간의 PPH 시행 프로그램의 실시 기간은 2026년 연장되며, 종료 예정일은 12년 31월 XNUMX일이다. 또한, 양자 모두 실시 기간은 필요에 따라 연장 될 예정이다.
따라서 앞으로도 일본 기업의 태국 및 인도네시아에서의 사업 전개는 더욱 진행될 것으로 예측된다.
또한 일본과 태국 간의 PPH 시험 프로그램을 이용하기위한 요구 사항에는 변화가 없다.
한편, 일본-인도네시아 간의 PPH 시행 프로그램을 이용하기 위한 요건이 아래와 같이 완화되었다. 구체적으로는, 종래는 일본의 특허출원에 근거한 인도네시아 지적재산총국(DGIP)에 대한 PPH의 신청은 특허출원 공개 후 2024월의 이의신청기간 경과 후에 실시할 필요가 있다는 시기 적 요건이 부과되었지만, 1년 XNUMX월부터 당해 시기적 요건이 철폐되었다.

G7지재청 장관급 회담 개최
2023년 12월 15일 일본 특허청(JPO)이 주최자 및 의장이 되어 G7 지재청 장관급 회담(G7 Heads of IP Office Conversation)이 개최되었다. 상기 G7 지재청 장관급 회담의 참가자는, G7 참가국(일본, 미국, 영국, 캐나다, 프랑스, 독일, 이탈리아)의 지재청의 장관급 등에 가세해, 옵저버로서 세계 지적 소유권 기관의 탄 사무국장이었다. 또, 상기 G7 지재청 장관급 회담은, 메타버스 공간상에서 개최되었다.
상기 G7 지재청 장관급 회담의 주된 의제는, 포괄성·다양성을 넓히기 위한 지재 보급 계발 활동, 및 디지털 영역에 있어서의 지재의 과제였다.
또한 JPO의 하마노특허청장관은 지재분야에서의 포괄성·다양성을 촉진하기 위한 JPO의 각종 시책, 디지털 공간에서의 모방행위 방지를 목적으로 한 2023년 6월 공포의 부정경쟁방지법 개정 등 일본에서 최근의 대처에 대한 정보를 발신하여 해당 정보를 G7 지재청 및 WIPO에 공유시켰다.
게다가, 상기 G7 지재청 장관급 회담에서, ①이노베이션 및 크리에이티티를 가속시키기 위해서는, 지재 에코시스템의 기존의 이해관계자에 그치지 않고, 지재의 혜택을 받을 수 있는 다양한 사람으로부터 의 강력하고 적극적인 관여가 필요함, ② 메타버스를 포함한 새로운 디지털 영역에 있어서의 지재의 문제 등, 최신의 과제에 대응할 수 있도록 지재 제도를 지속적으로 개선해 나가는 것이 중요 인 것에 대해, G7 지재청간에 인식을 공유되었다. 또 상기 G7 지재청 장관급 회담에서 이를 기재한 공동성명이 채택되었다.
앞으로는 일본을 포함한 G7 참가국에서 상기 공동성명에 근거하여 보다 포용적인 글로벌 지재 생태계 구축을 위해 다이버시티 & 인클루전을 촉진하는 경험과 대처를 공유하기 위한 각국간의 협력이 계속 및 추진되어 가는 것으로 생각된다. 또한, 메타 버스를 포함한 새로운 디지털 영역에서의 모방품 및 해적판에 관한 리스크에 대해 소비자 의식을 향상시키기 위한 법정비 등의 대처가 진행되어 가는 것으로 생각된다.

Japan-Thailand and Japan-Indonesia Patent Prosecution Highway Pilot Programs Extended
The implementation periods of the Patent Prosecution Highway (PPH) pilot program between Japan and Thailand and the PPH pilot program between Japan and Indonesia, which were scheduled to end on December 31, 2023, have both been extended.
Specifically, the PPH pilot program between Japan and Thailand has been extended by two years, with a scheduled ending date of December 31, 2025. This timing requirement has been eliminated as of January 2024.
As a result, making PPH applications based on Korean patent applications will become easier in Indonesia, which is expected to speed up the examination of patent applications.
Global IP Strategy Forum 2024
The “Global IP Strategy Forum 2024” will be held on January 25, 2024 at Kanda Square Hall in Tokyo, under the joint sponsorship of the Japan Patent Office and the National Center for Industrial Property Information and Training (INPIT).
The “Global IP Strategy Forum”, which has been held since 2015, aims to provide information that contributes to the development of IP strategies in conjunction with management strategies. G7 Heads of IP Office Conversation
The G7 Heads of IP Office Conversation was held on December 15, 2023, hosted and chaired by the Japan Patent Office (JPO). The participants in the G7 Heads of IP Office Conversation included the directors general, etc. of the IP Offices of the G7 member states (Japan, the US, the UK, Canada, France, Germany, and Italy) and, as an observer, Mr. Tang, Director General of the World Intellectual Property Organization. JPO Commissioner Hamano also shared with the G7 IP Offices and WIPO information on recent efforts in Japan, including various measures taken by the JPO to promote inclusiveness and diversity in the IP field and the revision of the Unfair Competition Prevention Law to be promulgated in June to prevent counterfeit acts in the digital space.
In addition, at the above G7 Heads of IP Office Conversation, the G7 IP Offices also shared their understanding regarding (1) the need for strong and active engagement not only from existing stakeholders in the IP ecosystem but also from various parties who cane IP in order to accelerate innovation and creativity, and (2) the importance of continuous improvement of the IP system to respond to the latest challenges such as IP issues in the new digital realm, including the metaverse. A joint statement mentioning the aforementioned matterwas adopted at the G7 Heads of IP Office Conversation.
It is expected that the G7 member states, including Japan, will continue to promote cooperation among themselves so as to share experiences and initiatives that promote diversity and inclusion, in order to build a more inclusive global IP ecosystem based on the abo addition, efforts will be made to advance legislation etc. to raise consumer awareness of the risks associated with counterfeiting and piracy in the new digital realm, including the metaverse.
