글로벌 지재 전략 포럼 2025 개최

특허청 및 독립 행정법인 공업 소유권 정보·연수관(INPIT)과의 공동 개최에 의해, 2025년 2월 21일에, 도쿄의 간다 스퀘어 홀에서, 「글로벌 지재 전략 포럼 2025」가 개최됩니다.

「글로벌 지재 전략 포럼」은, 2015년부터 개최되고 있는, 경영 전략과 제휴한 지재 전략의 구축에 이바지하는 정보 제공을 실시하는 것을 목적으로 한 포럼입니다. 또, 상기 포럼에 있어서는, 경영이나 지재 전략에 관한 국내외의 최신 주제가 소개되었습니다.

상기 「글로벌 지재 전략 포럼 2025」는, 작년도와 같이, 현지 개최에 가세해, 라이브 전달 및 개최 후에 기간 한정이지만 아카이브 전달이 실시됩니다. 또한, 현지 개최에 참가하기 위해서는 하기 HP 로부터의 신청이 필요하고, 라이브 전송 및 아카이브 전송의 시청에도 마찬가지로, 아래 HP로부터의 신청이 필요합니다.

현시점에서 예정되어 있는, 상기 「글로벌 지재 전략 포럼 2025」의 프로그램은 이하에 나타내는 바와 같습니다.

일본-프랑스 간 특허심사 고속도로 시행 프로그램의 기간 연장

일본국 특허청과 프랑스 산업재산청과의 사이에서, 2021년 1월 1일부터, 특허 심사 하이웨이(PPH) 시행 프로그램이 개시되고 있습니다.또, 상기 PPH 시행 프로그램의 대상이 되는 특허 출원의 범위 의 확대를 목적으로, 2023년 7월 1일부터 PPH MOTTAINAI 및 PCT-PPH의 접수가 개시되고 있습니다.

이번에, 상기 PPH 시행 프로그램의 유효기간이, 2025년 1월 1일부터 추가로 5년간 연장되었습니다.

덧붙여 PCT 출원은, 프랑스 산업 재산청에 직접 국내 단계 이행할 수 없는 것에 유의할 필요가 있습니다. 일본국 특허청이 작성한 국제 단계 성과물을 이용하여 PCT-PPH에 의한 조기 심사를 청구할 수 있는 경우는, 예를 들면, 이하의 (A)~(C)의 경우인 것에 유의할 필요가 있습니다.

(A) 프랑스 출원을 기초로 하는 파리 조약에 의한 우선권을 주장하여 실시한 PCT 출원의 국제 단계 성과물을 이용하여 당해 프랑스 출원에 대하여 PCT-PPH에 의한 조기 심사를 청구하는 경우.

(B) PCT 출원을 기초로 하는, 파리 조약에 의한 우선권 또는 국내 우선권을 주장해 실시한 프랑스 출원에 대해서, 당해 PCT 출원의 국제 단계 성과물을 이용하여, PCT-PPH에 의한 조기 심사 청구하는 경우.

(C) 프랑스 출원을 기초로 하는 파리 조약에 의한 우선권을 주장하여 실시한 PCT 출원의 국제 단계 성과물을 이용하여, 해당 프랑스 출원을 기초로 하는 국내 우선권을 주장하여 실시한 다른 프랑스 출원에 대하여 PCT-PPH에 의한 조기 심사를 청구하는 경우.

일본, 중국, 한국 간의 「특허 부여 후의 정정(보정) 요건」의 비교 결과 보고의 공개

일본특허청(JPO)에서 한중일심판전문가회합(Joint Experts Group of Trial and Appeal : JEGTA)에서 일본, 중국, 한국간의 '특허 부여 후 정정(보정) 요건'을 비교했다 결과가 기재된 보고서(영문, 일본문)가 공개되었습니다. 또한, 상기 보고서의 내용은, 2023년 11월 시점의 정보에 근거하는 것입니다.

Global IP Strategy Forum 2025

Extension of the Patent Prosecution Highway Pilot Program between Japan and France

The Patent Prosecution Highway (PPH) pilot program between the JPO and the French National Institute of Industrial Property (INPI) began on January 1, 2021. In addition, the PPH MOTTAINAI and PCT-PPH are being accepted from July 1, 2023, in order to expand the scope of patent applications eligible for the aforementioned PPH pilot program.

The validity of the aforementioned PPH pilot program has now been extended for another five years starting January 1, 2025.

It should be noted that PCT applications cannot be directly entered into the national phase at the INPI. Specifically, for an application filed with the INPI (hereinafter referred to as “French application”), an accelerated examination under the PC using an international work product prepared by the JPO in the following cases (A) to (C).

(A) Where the applicant requests accelerated examination under the PCT-PPH for a French application by using the international work product of a PCT application filed by claiming priority under the Paris Convention on the basis of said French application;

(B) Where the applicant requests accelerated examination under the PCT-PPH for a French application based on a PCT application and filed by claiming domestic priority or priority under the Paris Convention, by using the international work product of said PCT application;

(C) Where the applicant uses the international work product of a PCT application filed claiming priority under the Paris Convention on the basis of a French application to request accelerated examination under the PCT-PPH for a second French application filed claiming national of the first French application.

Publication of Comparative Study on “Requirements for Post Patent Grant Corrections (Amendments)” in Japan, China, and Korea

The Japan Patent Office (JPO) has published a report (in English and Korean) describing the results of a comparison of “Requirements for Post Patent Grant Corrections (Amendments)” in Japan, China, and Korea at the Joint Experts Group of Trial and Appeal (JEGTA). The contents of the aforementioned report are based on information as of November 2023.

Enforcement of the Revised “Handbook of Formalities Examinations”

In order to ensure uniform operation of formalities examination, the Handbook of Formalities Examinations has been revised from time to time in accordance with amendments to the law and associated changes in business operations. The newly revised Handbook of Formalities Examinations has been in effect since January 1, 2025.

The reasons for the revision of the Handbook of Formalities Examinations and the items that have been revised are as listed below. It should be noted that when carrying out procedures related to the aforementioned revisions, the procedures should be performed with reference to Formalities Examinations.
