한국지식재산처 및 유럽특허청과 심사관 협의

일본국특허청(JPO)은 외국지재청과의 심사관 협의를 오랫동안 실시해 왔다. 당해 심사관 협의는, JPO와 외국지재청과의 사이에서, 쌍방의 심사관과의 서로의 선행 기술 문헌 조사의 수법 및 심사 실무 등에 대한 논의를 통해, 신뢰감을 양성해 상호 이해를 심화시켜, 선행 기술 조사 결과·심사 결과의 상호 이용 등의 추진을 도모하는 대처이다.

그 심사관 협의의 대처의 일환으로서, 2026년 3월 9일부터 13일에 걸쳐, JPO와 한국지식재산처(MOIP)와의 심사관 협의, 및, JPO와 유럽 특허청(EPO)과의 심사관 협의가 실시되었다.

상기 JPO와 MOIP의 심사관 협의는 MOIP의 심사관을 JPO에 받아들이는 형식으로 실시되었다. 또, 당해 JPO와 MOIP와의 심사관 협의에서는, 로보틱스 및 유리 기술의 2개의 분야에 있어서, 양청 공통의 특허출원의 협의, 및, 상용 데이타베이스, FI, F텀의 이용을 포함한 선행 기술 문헌 조사의 수법 및 심사 기준의 운용 등에 대한 정보 교환이 행해졌다. 게다가 당해 JPO와 MOIP와의 심사관 협의에서는, JPO의 심사 툴 개발 담당 직원을 섞은, JPO와 MOIP의 양쪽의 특허 심사에 있어서의 AI 활용에 관한 의견 교환도 행해졌다.

따라서 당해 JPO와 MOIP와의 심사관 협의를 통해 JPO와 MOIP 사이에서 로보틱스 및 유리 기술 분야에 대한 서로의 심사 결과의 활용 등이 촉진되어 심사의 신속화가 진행될 것으로 기대된다. 또한 JPO와 MOIP에서는 특허심사에서 AI 활용이 더욱 진행될 것으로 기대된다.

상기 JPO와 EPO와의 심사관 협의는 JPO의 심사관을 EPO 뮌헨 오피스에 파견하는 형식으로 실시되었다. 또, 당해 JPO와 EPO와의 심사관 협의에서는, 전지 및 이동체 통신 시스템의 2개의 분야에 있어서의 비특허 문헌을 포함하는 선행 기술의 조사 수법, 심사 기준의 운용, 특허 분류의 부여 방침 등에 대한 정보 교환이 행해졌다. 또한, 당해 JPO와 EPO와의 심사관 협의에서는, 양청의 심사 및 분류 부여에 있어서의 AI 활용에 관한 의견 교환도 행해졌다.

따라서, 당해 JPO와 EPO와의 심사관 협의를 통해, JPO와 EPO의 사이에서도, 전지 및 이동체 통신 시스템의 분야에 대한 서로의 심사 결과의 활용 등이 촉진되어, 심사의 신속화가 진행될 것으로 기대된다. 또한 EPO에서도 특허심사에서 AI 활용이 더욱 진행될 것으로 기대된다.

 

특허청 스테이터스 리포트 2026의 공표

2026년 3월 23일 일본 특허청(JPO)으로부터 2025년 지적재산에 관한 통계정보 및 정책 성과를 게재한 '특허청 스테이터스 리포트 2026'이 공표되었다. 당해 「특허청 스테이터스 리포트 2026」에는, 지적 재산 제도를 둘러싼 현상 및 JPO의 대처 등이 기재되어 있다.

당해 「특허청 스테이터스 리포트(2026)」에는, 예를 들면, 이하에 나타내는 사항이 기재되어 있다.

  • 2016년~2025년에 걸친 일본 및 해외 출원 건수(특허, 실용신안, 의장, 상표) 등 일본 국내 및 해외에서의 지재 동향
  • 2025년 10월에 특허청이 오사카 박람회에 출전한 포럼 내용
  • 2025년 특허청이 시행한 시책 및 법 개정 내용

또한 해당 '특허청 스테이터스 리포트 2026'에서는 전 페이지에서 일본어와 영어를 병기하고 있으며, 지재의 최신 정보를 집약한 자료로서 국내외에서 활용이 가능하다.

또한, 상기 책자는 2026년 5월 중순 이후부터는 특허청 도서관에서 열람이 가능해진다.

 

방식 심사 편람 개정

일본국 특허청은 법개정 및 그에 따른 업무운용의 변경에 대응하여 방식심사편람의 내용을 적절히 재검토하여 개정하고 해당 개정의 내용을 공표해 왔다.

이번에 2026년 3월 25일에 방식심사 편람 개정이 공표되어 2026년 4월 1일부터 시행되었다.

개정의 내용으로서는, 이하의 (1)∼(3)에 나타내는 내용을 들 수 있다.

(1) 부정 경쟁 방지법 등의 일부를 개정하는 법률의 일부 시행(시행일:2026년 4월 1일)에 따른 온라인 송달 제도 도입에 맞추어, 해당 온라인 송달 제도에 관한 규정을 추가하는 개정.

(2) 공업 소유권에 관한 절차 등의 특례에 관한 법률 시행 규칙 등의 일부를 개정하는 성령의 시행(시행일:2026년 4월 1일)에 따른 포괄 위임장의 원용 제한 신고의 폐지에 맞추어, 해당 포괄 위임장의 원용 제한 신고에 관한 규정을 삭제하는 개정.

(3) 전술한 법률 및 성령의 시행에 의한, 운용 변경 및 운용 명확화를 위한 기재의 변경 및 항목의 신설 등을 실시하는 개정.

자동 생성·자동 부여형 검색 인덱스 「GAIA-Index」 운용 개시

일본국 특허청에서는 AI 기술을 활용한 자동 생성·자동 부여형 검색 인덱스 “GAIA-Index”(GAIA : Generative AI-based Architecture)의 업무 도입을 위한 실증이 이루어져 왔습니다. 그리고, 이번에, 2026년 4월 1일부터, 특허 정보 플랫폼 「J-PlatPat」상에서, 일부 테마에 대해 시행적으로 생성 및 부여한 상기 「GAIA-Index」를 이용한, F텀의 형식으로의 검색이 가능해지고 있습니다.

J-PlatPat의 특허·실용 신안 검색(선택 입력)에 있어서의 GAIA-Index의 구체적인 검색 방법은 이하에 나타내는 바와 같다.

(1) 검색 옵션을 이용하는 경우

  1. 검색 옵션으로 주 테마를 GAIA-Index를 가지는 테마(예를 들면 3D131)를 지정한다.
  2. 검색 키워드의 검색 항목을 "F 기간"으로 설정합니다.
  3. F 기간으로 GAIA-Index의 검색 키 (예 : OA01)를 지정하여 검색합니다.

(2) 검색 옵션을 이용하지 않는 경우

  1. 검색 키워드의 검색 항목을 "F 기간"으로 설정합니다.
  2. F 기간과 GAIA-Index의 검색 키(예: 3D131OA01)를 지정하여 검색한다.

또, 현재, 상기 「GAIA-Index」에서 이용 가능한 테마는, 이하에 나타내는 것입니다.

  • 3D131(타이어 일반)
  • 3D232(주행 ​​상태에 따른 조향 제어)
  • 4C160(수술용 기기)
  • 5F251(광기전력 장치)

따라서 향후 이러한 테마에 대해 AI를 이용한 고정밀도의 검색이 가능해질 것으로 기대할 수 있다.

또한, 향후 매년 4월에, 상기 「GAIA-Index」는, 생성 및 부여의 수법의 한층 더 개선 및 대상 테마의 확대를 실시하여 갱신될 예정이다. 그리고, 상기 갱신된 「GAIA-Index」는, 수시로 F 텀의 형식으로 검색 환경(J-PlatPat 등)에 반영될 예정이다.

따라서, 매년 4월의 상기 「GAIA-Index」의 갱신에 맞추어, 상기 「GAIA-Index」를 활용한 검색의 정밀도가 향상되어, 해당 검색 대상의 테마의 수도 증대해 나갈 것도 기대할 수 있다.

Examiner Meetings with the Korean Intellectual Property Office and the European Patent Office

Publication of the JPO Status Report 2026

Revision of the Formality Examination Manual

The Japan Patent Office has been reviewing and revising the content of the Formality Examination Manual as appropriate in response to legal amendments and associated changes in operational procedures, and has been publishing the details of these revisions.

A revision to the Formality Examination Manual was published on March 25, 2026 and came into effect on April 1, 2026.

The revision includes the following items (1) to (3):

(1) A revision to add provisions concerning the online delivery system, in line with the introduction of this system accompanying the partial enforcement (effective date: April 1, 2026) of the Act for the Partial Revision of the Unfair Competition Prevention Act, etc.

(2) A revision to delete provisions concerning the notification of restriction on citation of a general power of attorney, in line with the abolition of this notification of restriction on citation of a general power of attorney accompanying the enforcement (effective date: April 1, 2026) Enforcement of the Act on Special Provisions concerning Procedures relating to Industrial Property Rights, etc.

(3) Revisions involving changes to descriptions and the establishment of new items for the purpose of changing and clarifying operations due to the enforcement of the aforementioned Act and Ministerial Ordinance.

Launch of “GAIA-Index,” an Automatically Generated and Assigned Search Index

The Japan Patent Office has been conducting demonstrations for the operational introduction of “GAIA-Index” (GAIA: Generative AI-based Architecture), an automatically generated and assigned search index that utilizes AI technology. As of April 1, 2026, it is Japan Platform for Patent Information (J-PlatPat) using the “GAIA-Index,” which has been experimentally generated and assigned for some themes.

The specific method for searching with the GAIA-Index in the Patent & Utility Model Search (selection input) of J-PlatPat is as follows.

(1) When using search options:

  1. In the search options, specify a main theme that has a GAIA-Index (eg, 3D131).
  2. Set the search item for the search keyword to “F-term”.
  3. Search by specifying the GAIA-Index search key (eg, OA01) as the F-term.

(2) When not using search options:

  1. Set the search item for the search keyword to “F-term”.
  2. Search by specifying the F-term and the GAIA-Index search key (eg, 3D131OA01).

Currently, the themes available for the “GAIA-Index” are as follows:

  • 3D131 (General tires)
  • 3D232 (Steering control according to running condition)
  • 4C160 (Surgical instruments)
  • 5F251 (Photovoltaic devices)

It is expected that highly accurate searches using AI will become possible for these themes in the future.
