2017년 분야별 특허출원 기술 동향 조사 결과
4월 23일 일본국 특허청(JPO)은 영화 7년도 분야별 특허 출원 기술 동향 조사 결과를 공표했다. 시장 창출·확대가 전망되는 4가지 최첨단 기술 테마(핵융합 발전, 저탄소 연료 엔진, 유산균 함유 식품, 사이버 공격 검지 기술~부정 침입·멀웨어 등의 검지를 위한 정보 보안 기술~)에 대해 특허 정보 등에 근거하여 일본의 강점·과제 등을 분석해 보고서가 정리되었다.
(1) 핵융합 발전
핵융합 발전은 중수소와 트리튬을 고온의 플라즈마 상태에서 융합시키고, 그 반응에 의해 생기는 에너지를 전력으로 변환하여 이용하는 것을 목표로 하는 기술이다. 최근 일본에서도 핵융합 전략이나 퓨전 에너지·이노베이션 전략이 책정되는 등 핵융합 발전의 산업화·실용화를 위한 사회적 관심이 높아지고 있다.
2000년부터 2023년까지 국제 전개발명 건수 비율은 미국 국적이 31.0%로 선두를 두고 있으며, 이어 유럽 국적이 26.9%, 일본 국적이 21.7%, 중국 국적이 7.3%, 한국 국적이 4.6%로 이어지고 있는 것으로 나타났다.
또한 동기간 출원인별 국제전개발명건수 랭킹에서는 3위 양자과학기술연구개발기구, 7위 일본제철을 비롯해 상위 20자 중 7자가 일본국적 출원인임이 밝혀졌다.
게다가 기술 구분별 및 출원인 국적·지역별의 국제 전개 발명 건수로부터, 기기 구성의 기술 구분에 있어서, 일본은 널리 출원을 실시하고 있어, 타국·지역과 비교하면 「마그넷」 및 「로 전체」에 관한 출원이 특히 많아, 핵융합로의 요소 기술, 특히 핵융합 발전의 연구 개발의 초기에 필요한 플라즈마의 발생에 관하여 강점을 가진다.
(2) 저탄소 연료 엔진
국제전개발명건수는 2021년 이후 급격한 증가세이다. 출원인 국적·지역별로는 유럽적이 1,846건으로 가장 많아 전체의 34.0%를 차지합니다. 이어 미국적이 1,639건(30.2%), 일본국적이 1,108건(20.4%), 한국적이 352건(6.5%), 중국적이 225건(4.1%)으로 이어지고 있다.
또한 동기간 국제전개발명건수 출원인 랭킹에서는 6위 미쓰비시중공업그룹, 7위 토요타자동차(TOYOTA)그룹을 비롯해 상위 20자 중 6자가 일본 국적 출원인임이 밝혀졌다.
게다가 기술 구분별 및 출원인 국적·지역별 국제 전개 발명 건수로부터 일본은 '암모니아'를 연료로 사용하는 기술에 있어서 국제 전개 발명 건수가 상대적으로 많은 것이 밝혀졌다.
(3) 유산균 함유 식품
국제전개발명건수의 추이를 보면 연간 다소 증감은 있지만 전체적으로는 대개 증가세를 보이고 있다. 출원인의 국적·지역별로 보면 전 기간에는 유럽 국적이 986건(30.5%)으로 가장 많고, 이어 한국적이 572건(17.7%), 일본 국적이 460건(14.2%), 중국 국적이 441건(13.6%), 미국 국적이 429건(13.2%)이다. 또한 최근에는 한국적 및 중국적의 비율이 증가하는 경향이 있다.
또한 동기간 국제전개발명건수 출원인 랭킹에서는 3위 메이지, 6위 모리나가유업을 비롯해 상위 20자 중 6자가 일본 국적 출원인임이 밝혀졌다.
또한, 기술 구분별 및 출원인 국적·지역별의 국제 전개 발명 건수로부터, 일본은 「장내 환경의 개선」, 「면역 기능의 유지나 향상」, 「식미 향상」, 「발효유 음료」, 「보충제」 등에 있어서, 국제 전개 발명 건수가 많은 것이 밝혀졌다.
(4) 사이버 공격 검지 기술~부정 침입·멀웨어 등의 검지를 향한 정보 보안 기술~
2017年から2023年までの国際展開発明件数の合計は6,010件であり、出願人の国籍・地域別に見ると、全期間では米国籍が2,217件(36.9%)と最も多く、次いで欧州籍が1,189件(19.8%)、日本国籍が833件(13.9%)、中国籍が571件(9.5%)、韓国籍が472件(7.9%)となった。

미국 정부 감사원, 바이 돌법에 근거한 공개 절차 등에 관한 보고서를 공표
미국 정부 감사원(United States Government Accountability Office: GAO)은 연방 정부 자금을 바탕으로 한 발명의 권리 취득 상황과 연방 정부에 대한 본 발명의 개시 절차에 관한 의식 조사를 정리한 보고서를 공표했다.
바이도르법에 의하여 연방정부자금의 원조를 받아 발명한 자는 연방정부에 대한 공개의무 등을 완수하는 것을 조건으로 하여, 본 발명에 대하여 권리를 취득하고, 라이센스공여 등을 통해 스스로의 수익으로 하는 것이 가능하게 되어 있다.
본 보고서는 상원 지적재산소위원회 위원장의 티리스 의원(노스캐롤라이나주 선출, 공화당) 등의 조사요청에 부응하는 것으로 주로 다음 내용으로 구성되어 있다.
①연방정부자금원조를 받은 자에 의한 권리취득상황
바이도르법에 따라 2020~2024년도에 연방정부에 개시된 발명 중 자금원조를 받은 자가 권리 취득한 비율은 56%에 달했다. 한편, 권리를 포기한 비율이 21%, 권리의 필요 여부를 검토중인 비율이 18%였다.
권리 포기의 이유로는 상업화 가능성이 부족한 것(72.2%), 발명에 특허 적격성이 없었던 것(10.3%) 등이 있다.
② 연방정부에 대한 공개·보고의무에 관한 수속자의 문제의식
연방정부기관마다 요구되는 절차가 다르기 때문에 공개·보고에 추가적인 부담이 생기는 점이 문제점으로 지적되었다. 그 외 상업화를 위한 대처 내용에 관한 보고 부담이 큰 점 등을 지적하는 목소리도 있었다.
③ 공개절차시스템의 통합(통일시스템(iEdison)으로의 이행)
본 시스템의 이용은 공개 절차의 부담 경감에 기여한다는 목소리가 있었지만, 정부 기관 직원은 정보 공개 형식의 자유도가 높고, 절차자에 의해 내용에 편차가 있어 확인 부담이 큰 취지의 우려가 나타났다.
연방정부자금의 원조가 발명에 이르지 못한 경우의 보고에 대해서는 본 시스템을 통해 실시할 수 없는 점도 과제로 꼽혔다.
미국 국립표준연구소(NIST)는 2026년 3월부터 iEdison에서 정보공시 형식의 샘플 포맷을 새롭게 제공하고 있으며, 이 시스템을 통한 공개·보고 절차에 의해 통일적인 운용이 실현될 것으로 기대되고 있다.
USPTO, 특허 적격성에 관한 선서서의 운영 원활화를 위한 메모 개정
USPTO는 '특허 적격성에 관한 선서서(Subject Matter Eligibility Declarations: SMED)'의 제출 절차에 관한 모범 사례에 대해 출원인·대리인을 향한 메모를 개정·공표했다. 이것은, 2025년 12월에 공표된 메모에 대해서, 출원인으로부터의 피드백 등에 근거해 업데이트를 도모해, 보다 실용적인 가이던스로 하는 것을 목적으로 한 것으로 되어 있다.
이번 개정은 기존의 메모에 실체적인 변경을 가하는 것이 아니라, 현재 상황에서 SMED가 특허 적격성의 판단에 있어서 유효하게 기능하고 있는 것을 근거로, 주로 이하의 내용을 보충·확충하는 것이다.
- SMED의 기재 내용에 대해서, 선례도 참고로, 명세서에 기재된 기술적인 개선 내용이 당업자에 있어서 어떻게 해석되어야 하는지, 발명의 내용이 얼마나 효율적·효과적인 응용 기술인지를 설명하는 것이, 특허 적격성을 나타내기 위해 유효한 것.
- 특허심사관은 SMED를 포함하여 132규칙에 근거한 선서공술서에 의해 제출된 모든 주장·증거를 참작할 필요가 있다.
- 제출하는 SMED를 유의한 것으로 하기 위해서도 SMED를 비자명성 등에 관한 다른 선서 진술서와는 별도로 제출하는 것이 추천되는 것.

Results of 2025 Technology Trend Survey on Patent Applications by Field

(1) Fusion power generation
Fusion power generation is a technology aimed at fusing deuterium and tritium in a high-temperature plasma state and converting the energy generated by that reaction into electricity for use. In recent years, social interest in the industrialization and practical application of nuclear fusion power such as the formulation of a Nuclear Fusion Strategy and a Fusion Energy Innovation Strategy.
Looking at the ratio of the number of internationally filed inventions from 2000 to 2023, US applicants ranked first at 31.0%, followed by European applicants at 26.9%, Korean applicants at 21.7%, Chinese applicants at 4.6%.
In addition, in the ranking of applicants by number of internationally filed inventions during the same period, 7 of the top 20 applicants were Korean, including the National Institutes for Quantum Science and Technology in 3rd place and Nippon Steel in 7th place.
Furthermore, from the number of internationally filed inventions by technical category and by applicant nationality/region, it is clear that Japan has filed applications broadly in the technical categories of equipment configuration, and that, compared with other countries and regions, it as entire reactors, demonstrating strength in elemental technologies for nuclear fusion reactors, especially in plasma generation, which is required in the early stages of research and development for nuclear fusion power generation.
(2) Low-carbon fuel engines
The number of internationally filed inventions has shown a sharp upward trend since 2021. In terms of applicant nationality/region, European applicants accounted for the largest share with 1,846 cases, representing 34.0% of the total. They were (30.2%), Korean applicants with 1,108 cases (20.4%), Korean applicants with 352 cases (6.5%), and Chinese applicants with 225 cases (4.1%). In addition, in the ranking of applicants by number of international top 20 applicants were Korean, including Mitsubishi Heavy Industries Group in 6th place and the Toyota Motor (TOYOTA) Group in 7th place. US Government Accountability Office Publishes Report on Disclosure Procedures, etc. under Bayh-Dole Act
The United States Government Accountability Office (GAO) has published a report compiling the status of rights acquisition for inventions made with federal government funding and a survey of awareness concerning procedures for disclosing such inventions to the federal government.
Under the Bayh-Dole Act, persons who make inventions with the assistance of federal government funding may obtain rights to those inventions and generate revenue through licensing and the like, provided that they fulfill obligations such as disclosure to the federal govern.
This report responds to a request for investigation from Republican Senator Thom Tillis of North Carolina, Chairman of the Senate Intellectual Property Subcommittee, among others, and consists mainly of the following content.
(1) Status of rights acquisition by recipients of federal government funding
Of the inventions disclosed to the federal government between fiscal 2020 and 2024 under the Bayh-Dole Act, 56% were inventions for which the funding recipients obtained rights. On the other hand, 21% were inventions for which rights which the need to obtain rights was still under consideration. Reasons for waiving rights included poor prospects for commercialization (72.2%) and lack of patent eligibility of the invention (10.3%).
(2) Procedural concerns among those handling disclosure/reporting obligations to the federal government
It was pointed out as an issue that additional burdens arise in disclosure and reporting because the procedures required differ from one federal agency to another. It was also pointed out that there is a heavy reporting burden regardingeffort.
(3) Integration of disclosure procedure systems (migration to a unified system (iEdison))
While some stated that the use of this system helps reduce the burden of disclosure procedures, government agency staff expressed concerns that because there is a high degree of freedom in the format of information disclosure, the contents vary depending on the filer, resulting in pointed out as an issue that reports in cases where federal government funding did not lead to an invention cannot be made through this system.

USPTO Revises Memo to Facilitate Operation of Subject Matter Eligibility Declarations
The USPTO has revised and published a memo for applicants and representatives on best practices for filing procedures regarding Subject Matter Eligibility Declarations (SMED).The purpose is reportedly to update the memo published in December 2025 on the basis of feback more practical form of guidance.
This revision does not make substantive changes to the previous memo; rather, in light of the fact that SMED is currently functioning effectively in determinations of subject matter eligibility, it mainly supplements and expands on the following points made therein:
- With respect to the content of an SMED, reference can be made to precedent, and explanations of how a person skilled in the art should interpret the technical improvements described in a specification and how an invention constitutes an efficient and effective applied technology are ject
- Patent examiners are required to take into consideration all assertions and evidence submitted by affidavit or declaration under Rule 132, including an SMED.
- In order to make a submitted SMED meaningful, it is recommended that an SMED be submitted separately from other affidavits or declarations concerning matters such as non-obviousness.
