표준 전략 대응 심사(시행)에 대해서

연구개발 성과로서의 지재를 적절히 머니타이즈하여 「벌기」로 하고, 시장획득과 시장확대의 양립으로 연결하기 위해서는 연구개발과 은닉화・권리화(특허 등)・표준화 등을 조합 이를 통해 표준화와 지재의 체적 활용을 적절히 진행하는 것이 효과적이며, 표준화를 진행하는 것은 시장을 창출할 뿐만 아니라 사회·소비자의 안전과 편리성의 향상으로 이어진다.

특허청은 지금까지 특허심사의 신속성에 관한 목표를 내걸어 왔지만, 출원인 자신 또는 발명자가 속하는 기업 등이 표준화 활동(규격의 제정·보급을 향한 활동)을 실시하고 있는 기술에 관한 특허 출원에 대해서, 표준개발의 진척에 맞춘 유연한 특허 심사를 가능하게 하기 위해, 출원인이 희망하는 타이밍(심사 청구로부터 최대 24개월 후)에 심사를 실시하는 표준 전략 대응 심사의 시행을 개시한다.

출원인이 심사관에게, 표준 전략에 있어서의 표준 대상 기술의 위치 매김, 표준과 출원의 관계, 각 출원의 기술 설명 등을 실시하는 것으로, 심사관은, 표준의 내용 및 표준에 있어서의 특허 출원의 위치 결정 등을 파악한 후, 심사를 실시한다.

매년 7월에 그 해 10월 1일부터 다음 해 9월 30일까지 1년간 표준 전략 대응 심사 신청을 희망하는 출원인의 응모를 접수한다. 응모 방법의 상세는 매년 6월 중순경에 특허청의 홈페이지에서 공표할 예정.

또한, 표준 전략 대응 심사는 이용 상황을 확인하면서 유저의 의견도 근거로 유연하게 재검토가 이루어진다.

 

FRAND 라이센스 수수료에 대한 EPO 조사 보고서

EPO 감시기구 (EPO Observatory)는 표준 필수 특허 (SEP : Standard Essential Patents)의 공정하고 합리적이고 비 차별적 인 (FRAND : fair, reasonable and non-discriminatory) 라이센스 수수료 결정에 대한 조사 연구를 발표했다.

본 조사에서는 전세계 법원이 어떻게 FRAND 조건을 결정하고 있는지를 밝히기 위해 본 조사연구에서는 7개의 법역(국가·지역)에서 다양한 종류의 재판명령과 가이드라인을 포함한 65건의 재판판결을 수집하여 분석하고 있다.

조사에 의하면, 지난 13년간, 연간당 FRAND료율 결정의 건수는 0건에서 6건 사이에서 변동하고 있어, 건수의 추이에 명확한 경향(증감의 트렌드)은 보이지 않는다. 그러나 지리적 구성(국가·지역별 내역)은 현저하게 변화하고 있다. 2013년부터 2015년에 걸쳐 미국과 일본이 요금 설정을 이끌고 있었지만 지난 10년간 중국, 영국, 그리고 최근에는 인도가 주요 재판지(심판정)가 되고 있다.

2017년 이후 미국에서의 (법원에 의한 수수료) 결정 건수의 감소는 미국에서의 배심재판의 보급을 일부 반영하고 있다. 한편, FRAND료율의 「평가」 즉, 제시된 특정료율이나 오퍼(제안)가 FRAND조건에 합치하고 있는지 여부에 관한 판결은 유럽연합(EU), 특히 독일에 현저하게 집중하고 있다. 독일은 EU경쟁법에 근거한 표준필수특허(SEP)의 금지청구소송에서 제시된 라이선스 오퍼의 FRAND성을 평가하는 주요 재판지로 대두하고 있으며, 지난 몇 년간 통일특허재판소(UPC)도 이에 합류하고 있다.

 

절차기간 경과 후 권리구제에 관한 운영변경(USPTO)

USPTO는 2026년 6월 24일자에서 절차기간을 경과함에 따라 상실된 권리의 구제절차에 대해 절차기간의 비준수가 절차자의 고의에 의한 것이 아니었다는(unintentional) 입증에 관한 운용을 변경하는 최종규칙을 공표했다.

수속을 위한 기간이 정해져 있는 연금납부나 우선권주장 등의 특허관련절차에 대해서는 수속자가 그 기간을 준수하지 않았을 경우라도 소정의 수수료의 납부와 함께 신청을 하여 장관에 의해 그 지연이 고의가 아니었다고 인정된 경우에는 절차구제·권리회복하는 것이 가능하다. 한편, 장관에서는, 그 지연이 고의가 아니었는지 아닌지에 대해 의의가 있는 경우에는, 신청자에게 추가적인 정보를 요구하는 것이 인정되고 있다.

종래는, 장관에 의해 상기의 추가적인 정보 제공이 요구되는 경우에 대해서는, 수속 기간의 경과 후 2년을 경과한 후에 신청이 있었던 경우로 되어 있었다. 그러나 이번 최종규칙에 따라 동기간이 단축되고 절차기간 경과 후 1년을 경과한 후 신청이 있을 경우 추가적인 정보제공이 요구된다.

또한, 본 최종규칙에 의하면, 수속기간의 경과 후 1년을 경과하지 않은 경우라도, 지연이 고의가 아닌 것에 대해 의의가 있는 경우에는, 추가적인 정보 제공을 요구하는 경우가 있을 수 있다고 되어 있다.

또, 상술한 운용변경과 아울러, 종래는 수속기간의 경과 후 2년을 경과한 후의 신청에 있어서 필요했던 고액의 신청수수료에 대해서도, 수속기간의 경과 후 1년을 경과한 후에 행해지는 신청에 대하여 적용하는 취지의 규칙 개정을 실시한다.

본 최종규칙은 올해 8월 13일에 시행되어 같은 날 이후에 이루어지는 절차기간 경과 후의 구제에 관한 신청에 대하여 적용된다.

 

USPTO, PTAB 심리 개시 결정에 대한 장관 검토 신청 기한 연장

USPTO는 2026년 6월 29일 특허심판부(PTAB)에 있어서 당사자 검토(IPR)와 부여후 검토(PGR)의 심리개시 결정에 대한 장관 리뷰의 신청 기한을 연장한다는 것을 공표했다.

PTAB의 심리 개시 결정에 불복이 있는 경우의 장관 검토의 신청은, 정당한 이유가 있다고 인정되지 않는 한, 해당 결정으로부터 14일 이내에 행하는 것으로 되어 있는 바, 그 기한이 결정으로부터 30일 이내로 연장되게 된다. 

USPTO에 따르면 이번 운용 변경의 배경에는 올해 6월 선례(Precedential)로 지정된 장관 검토 결정이 있다. 본 사건에서는 PTAB에서 IPR의 심리개시결정이 있은 후에 병행제기된 특허권침해소송에서 심리대상 특허청구항이 모두 무효로 판단된 것을 이유로 USPTO 장관에 의해 심리개시결정이 뒤집혔다.

USPTO는 이 장관 검토의 신청 기한에 대하여 병행 제기된 소송과의 관계로 필요한 경우에는 예외적으로 추가 연장을 허용한다고 설명하고 있다. 구체적으로는 계속중인 병행소송에서 모든 청구가 각하된 경우 심리대상 특허청구항이 모두 무효로 판단된 경우 Sotera 합의(stipulation)가 파기된 경우 등이 이 예외적인 경우에 포함된다고 설명되어 있다.

당사자는 상기의 예외적인 경우에 해당한다고 생각할 경우 신청기한의 연장을 정당화할 수 있는 사정에 대해 3문 이내에 개략 기재한 후, 전자메일을 USPTO에 송부함으로써 신청할 수 있다.

 

2026년 WIPO 회원국 총회

2026년 7월 7일부터 7월 15일까지 세계지적소유권기관(WIPO) 회원국 총회가 스위스 제네바에서 개최되었으며, 일본에서는 허니시 특허청 장관, 야스다 특허기감을 비롯한 대표단이 참석했다.

총회의 1일째에는 일본을 대표해 허니시 장관이 일반 연설을 했다.

가니시 장관은 연설 속에서 제2기째인 탄 사무국장의 재임에 축의를 말한 뒤 지적재산제도가 세계 경제성청이나 사회과제 해결에 중요한 역할을 담당하고 있다는 점을 접하고 또 WIPO에 대해 국제출원·등록제도의 안정된 운용·개선에 감사한다는 것을 표명했습니다. 게다가 글로벌하고 지속적인 경제발전을 향해 중소기업·스타트업·기업가가 지적재산제도를 활용하는 것을 촉진하는 WIPO의 지원책이나, 사회과제인 기후변화에 대처하고자 하는 WIPO GREEN등의 WIPO의 대처에 대해서, 재팬·펀드를 통한 지원을 실시하고 있는 것을 지지하고,

총회에서는 각종 보고, 예산, 각 위원회의 활동 등에 대해 논의가 이루어졌다.

Trial of Patent Examinations Responsive to Standardization Strategies

EPO Study Report on FRAND Licensing Rates

The EPO Observatory has published a study on the determination of fair, reasonable, and non-discriminatory (FRAND) licensing rates for Standards Essential Patents (SEPs).

To clarify how courts around the world determine FRAND terms, this study collects and analyzes 65 court decisions, including various types of court orders and guidelines, across seven jurisdictions (countries/regions).

According to the study, the annual number of FRAND rate determinations has fluctuated between 0 and 6 over the past 13 years, with no clear trend (upward or downward trend) in the trajectory of the number of cases. However, the geographical composition (breakdown While the United States and Japan led rate-setting from 2013 to 2015, over the past 10 years, China, the United Kingdom, and more recently, India have become major litigation venues (courtrooms).

The decrease in the number of (court-determined rate) decisions in the United States since 2017 partly reflects the prevalence of jury trials in the US. On the other hand, judgments regarding the “assessment” of FRAND rates, that is, whether a specific proposed rate concentrated in the European Union (EU), particularly in Germany. Changes in Practice Regarding Restoration of Rights After Expiration of Procedural Period (USPTO)

On June 24, 2026, the USPTO published a final rule changing its practice regarding establishment of the fact that non-compliance with a procedural period was unintentional in procedures for restoring rights lost due to the expiration of a procedural.

For patent-related procedures with set periods, such as maintenance fee payments and priority claims, even if the practitioner fails to comply with the period, they can apply for restoration of rights/remedy with the payment of a prescribed fee, and if the Director finds at remedies and restoration of rights are possible. On the other hand, the Director is permitted to require additional information from the applicant if there is a question as to whether the delay was indeed unintentional.

Previously, cases where the Director required the submission of such additional information were those where a petition was filed more than two years after the expiration of the procedural period. However, the final rule shortens this period, and additional information will than one year after the expiration of the procedural period.

Furthermore, according to the final rule, even if one year has not passed since the expiration of the procedural period, additional information may still be required if there is a question as to whether the delay was unintentional.

In addition, in conjunction with the above practice change, the rule is amended to apply the high petition fee, which was previously required for petitions filed more than two years after the expiration of the procedural period, to petitions filed more than period.

This final rule will take effect on August 13 of this year and will apply to petitions for remedy after the expiration of a procedural period filed on or after that date.

 

USPTO Extends Deadline to Request Director Review of PTAB Institution Decisions

On June 29, 2026, the USPTO announced that it would extend the deadline for requesting Director review of decisions to institute inter partes review (IPR) and post-grant review (PGR) before the Patent Trial and Appeal Board (PTAB).

While requests for Director review in case of dissatisfaction with a PTAB institution decision previously had to be filed within 14 days of the decision unless there were justifiable reasons, the deadline will now be extended to within 30 days of the decision.

According to the USPTO, the background to this practice change is a Director review decision designated as precedential in June of this year. In this case, after the PTAB issued a decision to institute an IPR, the USPTO Director vacated the institution decision on the grounds determined to be invalid in a parallel patent infringement lawsuit.

The USPTO explained that, in connection with parallel litigation, it will exceptionally allow further extensions of the deadline to request Director review if necessary. Specifically, such exceptional cases are described as including instances where all claims in a pending paralle under review are found to be invalid, or a Sotera stipulation is undone.

If a party believes that their case falls under the above exceptional circumstances, they can apply for an extension of the deadline by submitting an email to the USPTO with a brief explanation in three sentences or less of the circumstances justifying the extension.

 

2026 WIPO Assemblies of the Member States

From July 7 to July 15, 2026, the Assemblies of the Member States of the World Intellectual Property Organization (WIPO) were held in Geneva, Switzerland, and a delegation from Japan including JPO Commissioner Yasuyuki Kasai and Deputy Commissioner Futoshi Yasud.

On the first day of the Assemblies, Commissioner Kasai delivered a general statement on behalf of Japan.

In the statement, Commissioner Kasai congratulated Director General Daren Tang on his reappointment for a second term, touched upon the important role that the intellectual property system plays in global economic growth and resolving societal challenges, and expressed gratitude to WIPO for the systems. In addition, Commissioner Kasai mentioned Japan's support through the Japan Funds-in-Trust for WIPO's initiatives, such as WIPO's support measures to promote the utilization of the intellectual property system by small and medium-sized enterprises and start development, and WIPO GREEN, which aims to address the societal challenge of climate change, and reaffirmed Japan's support for these initiatives.

During the Assemblies, discussions were held on various reports, the budget, and the activities of each committee.
