정부 '지적재산추진계획 2026' 결정
정부는 2026년 6월 12일 제55회 지적재산전략본부를 개최해 '지적재산추진계획 2026'을 결정했다. 지재 전략은 올 여름에 정리하는 일본 성장 전략의 중요한 요소이며, 지재의 힘으로 일본의 성장을 가속할 수 있도록 본부장인 다카이치 총리는 부본부장인 오노다 내각부 특명 담당 장관에게 「지적 재산 추진 계획 2026」을 신속하게 실행에 옮기도록 지시했다.
지적재산추진계획 2026의 주요 포인트는 다음과 같다.
1. 지재·무형 자산에 대한 투자 촉진에 의한 가치 창조
· 지재 · 무형 자산을 중심으로 한 국가 전략 · 성장 전략 추진
· 경영 전략의 중심에 지재 · 무형 자산을 설치 한 지재 경영의 추가 침투
2. 생성 AI 등의 새로운 시대에 맞는 지적 재산 보호
・생성 AI 기술의 진보 촉진과 지적 재산권의 적절한 보호의 양립
・경제안보 시대에 적합한 실효적인 지적재산 보호를 위한 제도적 수당의 존재방법의 검토
3. 성장 투자로 콘텐츠 전략 추진
・「콘텐츠 분야 관민 투자 로드맵」에 근거하는 대규모·장기·전략적인 관민 투자
AI와 지적 재산권에 대해, 생성 AI의 급속한 진전에 의해, 학습 데이터의 취급, 생성물과 저작권 등과의 관계 등, 지재 제도와의 관계를 둘러싼 새로운 과제가 현재화되고 있는 현상을 감안하여, 권리자나 이익 사용자에게 안전・안심한 이용 환경을 확보하는 것을 목적으로 하는 프린시플 코드(가칭)를 제정함과 동시에, 크리에이터 등에 대한 대가환원을 위한 환경 구축을 촉진할 예정이다.
또한 산업재산권 제도·운용의 강화에 대해 권리침해가 생겼을 때 신속하고 적절하게 분쟁을 해결할 수 있음과 동시에 침해를 억제할 수 있는 환경이 필수적이기 때문에 권리자가 실효적으로 권리행사할 수 있는 환경을 정비하기 위해 사증제도 등의 증거수 집수속의 충실·강화의 본연의 방법을 검토한 후, 그 저작권 등에의 확대의 가능성, 해외 소재 증거에의 대응의 본연의 자세 등에 대해서, 필요한 검토를 실시해, 또, 집단적·조직적인 지적 재산권의 행사를 가능하게 하는 구조를 검토할 예정이 되고 있다.
게다가, 지역의 지재 보호에 대해, 우량한 식물 신품종이나 식문화 등의 지재는, 농림 수산업·식품 산업의 강점인 한편 해외 유출이나 모방품의 증가의 리스크도 확대하고 있는 현상을 감안해, 우량 품종의 해외 유출을 방지해 해외로부터의 벌기 에 연결해 나가기 위해, 육성자권 관리 기관을 올 여름에 시작해 사업화해, 또, 해외에서의 모방품의 실태를 파악해 정확하게 대응해 가는 것과 동시에, GI나 상표등에 의해 브랜드를 보호·활용하는 모델적인 대처를 추진할 예정이 되고 있다.

「봉봉 드롭 씰」모방품 배제와 상표 등록에 의한 브랜드 보호
인기의 씰 상품 「봉봉 드롭 씰」의 위조품을 판매, 또는 판매 목적으로 소지하고 있었다고 해, 상표법 위반(상표권 침해)의 혐의에 의한 체포자가 각지에서 잇따르고 있다.
이러한 적발은 실제로 위조품을 구입한 사람으로부터의 신청이나, 동상품의 상표권자인 「주식회사 쿨리아」로부터의 정보 제공에 근거하는 경찰의 사이버 순찰 강화에 의해 실현되었다.
주식회사 쿨리아는 자사 브랜드 및 상품의 보호를 목적으로 아래와 같이 상표등록을 완료하고 있다.

상표법상 권리가 침해된 경우 상표권자는 민사상의 조치로 '차지청구'나 '손해배상청구', '부당이득 반환청구' 등을 요구할 수 있다. 그러나 상표권 침해행위에 대한 페널티는 이에 그치지 않는다.
상표법에는 상표권을 직접 침해한 자 또는 침해로 간주되는 행위(예비행위 등)를 한 자에 대한 형사벌이 규정되어 있다. 상표권을 침해한 개인에 대하여는 10년 이하의 징역 또는 1000만엔 이하의 벌금 또는 둘 다가 부과될 수 있다(상표법 제78조). 또한, 침해로 간주되는 행위를 행한 자에 대해서는 5년 이하의 징역 또는 500만엔 이하의 벌금, 또는 양쪽 모두가 부과될 가능성이 있다(상표법 제78조의2).
또한 상표권 침해죄는 '비친고죄'이다. 상표권자로부터의 고소가 없어도 경찰 등의 수사기관의 독자적인 판단에 의해 수사 및 기소가 진행되는 경우가 있다.
이번 각지에서 잇따르는 체포극은 상표등록이라는 법적인 방패가 악질적인 위조품 단속에서 강력한 무기로서 기능하고 있음을 보여주는 좋은 예라고 할 수 있다.
종묘법 개정안중원 본회의에서 통과
당소 뉴스레터 4월호에서 농림수산성이 종묘법 개정안을 국회에 제출한 것을 거론했지만, 6월 19일 중원 본회의에서 해당 종묘법 개정안이 통과됐다.
종묘법 개정의 주된 목적은 국내에서 개발된 우량한 신품종의 유출 방지와 개발자를 보호하는 '육성자권'의 강화다.
이번 개정안의 포인트는 다음과 같다.
1 무단 수출의 금지 청구권의 조기화
품종등록출원중이라도 제3자에 의한 무단수출을 주는 청구권이 신설된다.
종래, 제3자에 의한 무단 수출을 금지하는 것은, 품종 등록이 완료 후였다. 출원으로부터 등록까지는 최장으로 6년 정도 걸리는 경우가 있어, 이 심사 기간중에 종묘가 해외에 유출되는 리스크가 지적되고 있었다.
2 육성자권의 존속기간의 연장
신품종의 생산과 판매 등을 독점할 수 있는 '육성자권'의 적당기간이 10년 연장된다.
3 무단 반출에 대한 대응
해외로의 반출 제한이 있는 등록품종에 대해 재배지역이나 수출처의 조건을 위반하여 반출하는 것을 막기 위한 규제가 강화된다.

Elimination of Counterfeits of “Bonbon Drop Stickers” and Brand Protection through Trademark Registration
