영국의 마드리드 협정 의정서 비준을 저지로 확장

2026년 5월 12일 영국 정부는 마드리드 협정의정서 비준을 저지 관할구로 확장하는 선언을 WIPO에 기탁했다. 이 확장의 효력은 2026년 8월 1일부터 발생한다.
이날 이후 영국의 지정은 저지에 미치지 못하고, 출원인은 영국과는 독립적으로 저지를 개별 지정할 필요가 있다. 저지의 지정에 있어서는, 개별 수수료의 지불이나 「상표의 사용 의사의 선언」이 의무지워진다. 또한 당일 시점에서 유효한 영국 지정의 국제등록에 대해서는 저지에 자동으로 지정이 기록되는 경과조치가 강구된다.
본국과 속령 등에 있어서의 3개의 지정 패턴
본국과 해외 영토·자치령 등에 있어서의 마드리드 제도의 적용 관계는, 이하의 3패턴으로 대별된다.
① 본국 지정에 의해 자동 확장되는 패턴
본국을 지정하는 것만으로, 부수하는 영역에도 자동적으로 효력이 미친다.
(예)
- 프랑스와 해외현·해외 영토: 프랑스의 지정에 의해 기아나나 불령 폴리네시아, 레유니온 등에 자동적으로 효력이 미친다.
- 덴마크와 그린란드 - 페로 제도 : 덴마크의 지정은 자치령 인 그린란드와 페로 제도 모두에게 자동으로 효력이 있습니다.
- 영국과 맨섬·지브롤터 등: 영국의 지정에 의해, 영국, 웨일즈, 스코틀랜드, 북아일랜드뿐만 아니라, 맨섬, 지브롤터, 포클랜드 제도 등에도 자동적으로 효력이 미친다(※저지는 2026년 8월 1일까지 본 패턴에 해당).
② 본국과는 별도로 지정할 필요가 있는 패턴
본국의 지정에서는 효력이 미치지 않고, 독립한 영역으로서 개별 지정과 수수료 지불을 필요로 한다. 이행 후 '영국과 저지'도 이 패턴에 해당한다.
(예)
- 네덜란드와 카리브 지역(큐라소, 신트마르텐, BES 제도): 유럽 네덜란드와는 별도로 별도의 지정이 필요하다.
③ 본국 지정에 포함되지 않고 개별 지정도 불가의 패턴
본국은 조약 회원국이지만 특정 영역을 제외하고 있으며, 마드리드 제도에서 지정 자체를 할 수 없다.
(예)
- 중국과 홍콩·마카오: 중국을 지정해도 특별 행정구의 홍콩·마카오에는 보호가 미치지 않는다. 또, 마드리드 제도를 이용하여 「홍콩」이나 「마카오」를 개별적으로 지정할 수 없기 때문에, 보호를 요구하는 경우는 현지의 지적 재산국에 직접 출원을 실시할 필요가 있다.
실무상의 유의점
본국과 자치령 등의 관계성은 법개정 등으로 변경되므로 이행조치 유무 등 개별 구체적인 확인이 필요하다. 권리 보호 누출을 방지하기 위해서도 대상 지역이 어느 패턴에 속하는지를 정확하게 파악해야 한다.

JASRAC, AI를 이용한 작품의 취급에 관한 가이드라인을 공표
일본 음악저작권협회(JASRAC)는 공식 사이트 내에 생성 AI와 저작권에 관한 특설 페이지를 시작하여 인공지능(AI)을 이용한 작품의 취급 등에 관한 가이드라인을 공표했다.
가이드 라인의 개요는 다음과 같습니다.
■관리 대상으로 하는 작품
→AI(인공지능)를 이용한 작품에 대해서는 인간의 창작적 기여가 인정되는 작품을 관리 대상으로 한다. 한편 단순한 지시에 근거하여 AI가 자율적으로 생성한 가사 또는 악곡은 저작물에 해당하지 않기 때문에 관리대상으로 하지 않는다.
■가사 또는 악곡의 어느 한쪽을 AI가 자율 생성해, 다른 한쪽을 사람이 창작한 작품의 관리에 대해서
→가사 또는 악곡의 한쪽이 PD(퍼블릭 도메인)인 작품과 같은 취급으로 한다.
■AI를 이용한 작품을 신고할 경우
→AI를 이용한 작품을 신고할 경우에는 사람이 창작적으로 기여한 저작물임을 위탁자 자신이 보증할 의무가 있다.

특허청 “모방품·해적판 대책의 상담 업무에 관한 연차 보고(2026년판)”에 보는 최신 동향과 대책
특허청은 2026년 6월 ‘모방품·해적판 대책 상담 업무에 관한 연차보고(2026년판)’를 공표했다. 본 보고서는 2025년에 있어서의 「정부 모방품·해적판 대책 종합 창구」의 상담 및 정보 제공의 접수 상황을 정리한 것이다.
당소 뉴스레터에서는 이 보고서에서 읽을 수 있는 모방품 피해의 최신 동향과 향후 실무에서 유의해야 할 포인트를 정리해 해설한다.
상담·정보 제공 접수의 개황
2025년 상담·정보 제공 접수 건수는 총수 686건이며, 그 내역은 정보 제공이 563건, 상담이 123건이었다. 접수 방법으로는 이메일이 전체의 89.5%를 차지하고 있어 창구에 대한 액세스 수단으로 정착하고 있는 것 같다.
인터넷 거래 관련이 전체의 약 8 %
창구에 전해진 안건 가운데 인터넷 거래 관련(통판 사이트, 경매, 프리마, SNS, 불법 업로드·다운로드의 합계)은 항목 베이스로 543건에 이르고, 전체(항목 베이스)의 약 80%를 차지하고 있다.
CtoC 거래 및 SNS를 통한 상승:
불법 업로드·다운로드(39.6%)가 최다이지만, 프리마 앱(23.6%)이나 SNS(9.2%) 등 개인간(CtoC) 거래에 관련된 상담·정보 제공이 다수 전해지고 있다. 최근에는 프리마 앱에서의 출품과 사기적인 SNS 광고를 통한 모방품 판매의 수법이 눈에 띄는 점이 특징이다.
피해가 현저한 지적재산권 및 상품분야
지적재산권별 추세:
'상담'에서는 상표권(45.9%) 및 저작권(32.2%)이 상위를 차지하고, '정보제공'에서는 저작권(54.0%) 및 상표권(33.1%)이 대부분을 차지한다. EC사이트 등에 있어서의 브랜드 위장(상표권 침해)이나, 화상·콘텐츠의 무단 전재(저작권 침해)가 다발하고 있는 현상이 뒷받침되고 있다.
상품 분야별 추세:
상품의 종별이 뚜렷한 상담(44건) 중 일반기계·산업기계(29.5%)와 잡화(29.5%)가 같은 비율로 최다였고, 이어 섬유(25.0%)였다.
향후 실무 대책
인터넷을 통한 모방품 유통은 소구화·교묘화하고 있어 권리자 단독으로의 감시 및 배제에는 한계가 생기기 쉽다. 이러한 상황에서는 다음과 같은 조치를 취하는 것이 좋습니다.
다각적인 모니터링 구현:
기존의 통신판매 사이트 감시에 가세해 SNS상의 광고나 프리마 어플리에서의 유통 상황에 대해서도 정기적인 조사를 짜넣는다.
수중 대책 강화(세관과의 제휴):
모방품의 국내 유입을 막기 위해 재무성 관세국(세관)에 대한 수입차단신청절차를 시야에 둔다.
정부 종합 창구 활용:
국외사안에 있어서의 권리행사 방법이나 대응 수단의 검토에 있어서는, 특허청의 「정부 모방품·해적판 대책 종합 창구」를 통한 정보 수집이나, 전문 기관의 소개를 받는 것이 매우 유효하다.
모방품 대책은 기업의 브랜드 가치 및 경제적 이익에 직결하는 중요한 과제이다. 구체적인 권리행사 여부와 제도의 이용에 있어서는 개별 상황에 따른 법적 판단이 필요하다. 당소에서도 모방품 대책을 전문으로 하고 있어 수시로 상담을 받고 있다.

Extension of United Kingdom's Ratification of Madrid Protocol to Jersey
Summary of the WIPO Notification
On May 12, 2026, the Government of the United Kingdom deposited with WIPO a declaration extending its ratification of the Madrid Protocol to the Bailiwick of Jersey. This extension will take effect on August 1, 2026.
On and after the same date, designations of the United Kingdom will no longer extend to Jersey, and applicants will need to designate Jersey individually and independently from the United Kingdom. When designating Jersey, the payment of an individual fee and a “declaration of intention to use the mark” that are active as of the same date, a transitional measure will be taken under which a designation of Jersey will be automatically recorded.
Three Designation Patterns between a Home Country and its Territories
The applicability of the Madrid System between a home country and its overseas territories, self-governing territories, etc., can be broadly classified into the following three patterns.
(1) Pattern where the protection is automatically extended by designating the home country
By simply designating the home country, the effects automatically extend to the associated territories.

By designating France, the effects automatically extend to French Guiana, French Polynesia, Reunion, etc. - Denmark and Greenland/the Faroe Islands:
By designating Denmark, the effects automatically extend to both of the self-governing territories of Greenland and the Faroe Islands. - The United Kingdom and the Isle of Man, Gibraltar, etc.:
By designating the United Kingdom, the effects automatically extend not only to England, Wales, Scotland, and Northern Ireland, but also to the Isle of Man, Gibraltar, the Falkland Islands, etc. (this also applies to Jersey until August 1, 2026).
(2) Pattern where designation must be made separately from the home country
The designation of the home country does not extend the effects to an associated territory, and individual designation and fee payment are required for said territory as an independent territory. Following the transition, this will apply in the case of the United Kingdom and Jersey.

(3) Pattern where the territory is not included in the designation of the home country and individual designation is also not possible

JASRAC Publishes Guidelines on the Handling of Works Utilizing AI
The Japanese Society for Rights of Authors, Composers and Publishers (JASRAC) has launched a special page on generative AI and copyright on its official website and published guidelines on the handling of works utilizing artificial intelligence (AI).
The outline of the guidelines is as follows:
■Works Subject to Management
→For works utilizing AI, works in which human creative contribution is recognized will be subject to management. On the other hand, lyrics or musical compositions autonomously generated by AI based on simple instructions do not constitute copyrighted works, and therefore will
■Management of Works where One of Either Lyrics or Musical Compositions are Autonomously Generated by AI and the Other is Created by a Human
→These works will be treated in the same manner as works where either the lyrics or the musical compositions are in the public domain (PD).
■Filing of Works Utilizing AI
→When filing a work utilizing AI, the trustor themselves has an obligation to guarantee that a human has creatively contributed to the work.
Regarding the relationship between AI and copyright, the Agency for Cultural Affairs also compiled “Approach to AI and Copyright” at the Subdivision on Copyright of the Council for Cultural Affairs' Subcommittee on Legal Matters in March 2024 in order to meet the need generative AI and copyright, and to organize and publicize the approach to generative AI and copyright.

Latest Trends and Measures in JPO's “Annual Report on Consultation Services for Counterfeit and Pirated Goods (2026 Edition)”
In June 2026, the Japan Patent Office (JPO) published the “Annual Report on Consultation Services for Counterfeit and Pirated Goods (2026 Edition)”. This report compiles the status of consultations and information provision received by the “Government Consultation Counter for Counter2025
In this article, we will organize and explain the latest trends in damages caused by counterfeit goods found in the report, as well as key points to keep in mind for future practical operations.
Overview of Consultations and Information Provision Received
In 2025, the total number of consultations and information provisions received was 686. Of these, 563 were information provisions and 123 were consultations. By method of receipt, e-mail accounted for 89.5% of the total, suggesting be accessing the consultation counter.

In addition to traditional monitoring of e-commerce sites, periodic investigations into advertisements on SNS and distribution status on flea market apps should be incorporated.

To prevent the inflow of counterfeit goods into the country, procedures for filing an application for suspension of import with the Customs and Tariff Bureau of the Ministry of Finance (Customs) should be considered.

When considering enforcement methods and response measures for overseas cases, it is extremely effective to gather information through the JPO's “Government Consultation Counter for Counterfeit and Pirated Goods” or to receive introductions to specialized organizations.
