Identity verification measures regarding signature (operational changes to be implemented on and after January 1, 2022)

On October 29, 2021, the Japan Patent Office (JPO) announced that operational changes made to identity verification measures regarding a signature would be implemented on and after January 1, 2022.

The operational changes include the following: For seal impressions affixed to procedure documents and deeds, a seal registration certificate will need to be submitted. For signatures put on deeds by foreigners, a measure that enables identity verification will be required.

For signatures that are put on deeds (including a deed of assignment) required for a notification of change of applicant and an application form for transfer of registration, the JPO will require any one of the following certificates, etc. that pertain to identity verification of a signature.

(1) Incorporation, into an application form, etc., of a statement that "the intent of persons including an assignor has been confirmed" written by a patent attorney or an attorney-at-law who represents an assignor or an assignee
(2) Submission of a deed of assignment accompanied by a certificate (including a face-to-face certification and self-certification) pertaining to the authenticity of a signature
(3) Submission of a certificate of signature
