First Action Interview Pilot Programの適用が拡張される技術分野

１．本プログラムの手続概要
ＵＳＰＴＯは、２００９年１０月１日付で、２００９年１０月０１日から６ヶ月間、他の技術分野にもFirst Action Interview Pilot Programの適用分野が拡張されています。

ＵＳＰＴＯからの問い合わせに対して、出願人が本プログラムの参与を希望する場合、審査官は、先行技術調査を行い、出願人に対してPre-interview Communication（クレーム発明に対する拒絶理由の簡略化したpreview）を発行します。なお、出願人が本プログラムの参与を希望しない場合、通常どおりの審査手続が行われます。

Pre-interview Communication の発行から３０日以内に、出願人は、First Action Interview を審査官に求めるか否かを選択し、審査官とのｲﾝﾀﾋﾞｭｰを求める場合には、補正案または反論案をファイルしなければなりません。なお、また、Pre-interview Communication への応答期限は３０日間延長可能です。

Pre-interview Communicationの受領後、出願人がFirst Action Interview を審査官に求めることを希望しない場合、First Action Interview office actionが発行され、出願人は、１ヵ月か３０日のいずれか長い方の期間内に応答しなければなりません。一方、First Action Interview を審査官に求めることを希望する場合、出願人はクレーム発明の特許性について意見を具申しなければなりません。

特許性に関し、審査官と出願人との間で合意に至らなかった場合、出願人は、First Action Interview office action を受領し、１ヶ月の応答期間内に応答する（期間延長は限られている。）と、このFirst Action Interview office actionは、本願のFirst Actionと見なされます。

出願人は、審査官とのｲﾝﾀﾋﾞｭｰの間、First Action Interview office actionを受領する権利を放棄すること、前回ファイルした補正案を正式な補正とすること、及び２回目の実体審査へ進むことも可能です。

２．本プログラムにおいて出願人が講じ得る措置
以前は、全ての出願人が手続の全ての段階に関与することが必要でしたが、今回のプログラム試行延長措置以降は、審査官の先行技術調査の結果を含むPre-interview Communicationを受領した後、出願人は以下のいずれかの措置を選択できるようになりました。

３．その他の留意事項
・ Interview Request Formをファイルしてから２ヵ月以内に審査官とのｲﾝﾀﾋﾞｭｰを行うことが可能となる（以前は、Pre-interview communicationの郵送日から２ヵ月以内に審査官とのｲﾝﾀﾋﾞｭｰを行うことが可能でした。）。

・ Pre-Interview Communication に対する応答期間は、更に１ヶ月延長可能（以前は、期間延長は認められていませんでした。）。

・ Pre-Interview Communicationに対して期限までに応答しない場合、又は審査官とのｲﾝﾀﾋﾞｭｰを期限までに行わない場合であっても、出願は放棄扱いにはならない（ただし、審査官とのｲﾝﾀﾋﾞｭｰを行う権利を放棄した場合と同様にFirst actionが発行されます。）。

・ 出願人による本プログラムへの参与請求は、本プログラムの実施期間である６ヶ月以内（2010年4月1日まで）であってFirst Office actionの発行の少なくとも１日前にファイルすることが必要（なお、出願のステータスは、Patent Application Information Retrieval (PAIR) systemで閲覧することが可能です。）。

・ 本プログラムへの参与請求は、EFS-Web（http://www.uspto.gov/ebc/index.html）を介して行うことが必要。

４．本プログラムの適用技術分野
本プログラムが適用される技術分野は、特許出願の出願日によって決まっています。具体的には、以下に示すグループの一つに属する特許出願が本プログラムの適用対象となります。
・ Applications filed on or before November 1, 2006, and assigned to workgroup 1610 (art units 161X)
・ Applications filed on or before October 1, 2006, and assigned to art unit 1795
・ Applications filed on or before February 1, 2008, and assigned to workgroups 2150 and 2160 (art units 215X and 216X)
・ Applications filed on or before July 1, 2008, and assigned to workgroups 2440 and 2450 (art units 244X and 245X)
・ Applications filed on or before June 1, 2007, and assigned to art unit 2617
・ Applications filed on or before May 1, 2008, and assigned to art units 2811-2815, 2818, 2822-23, 2826, 2891-2895
・ Applications filed on or before December 1, 2007, and assigned to art unit 3671
・ Applications filed on or before January 1, 2008, and assigned to art unit 3672
・ Applications filed on or before November 1, 2007, and assigned to art unit 3673
