新年のご挨拶

新年あけましておめでとうございます。

昨年は、イスラエルによるパレスチナ・ガザ地区への攻撃がほぼ終焉を迎える一方、ロシアによるウクライナ侵攻の激化、台湾問題をめぐる中国と日本との間の国際摩擦の激化、トランプ大統領による高額関税化とUS第一主義政策に伴う米国一極集中化、等々、世界の政治及び経済は、『大国』の身勝手な振る舞いが横行する混沌とした困難な時代に遭遇しています。一日も早く『世界平和』が訪れることを願わずにはいられません。

一方、当事務所においては、昨年も同様に、業績が順調に進展し、一年を通して繁栄と多忙を極めた「輝かしい年」でした。顧客の皆様、そして全所員の皆様に、心から深い感謝を申し上げます。誠にありがとうございました。初心に戻り、常日頃、お客様のご厚情に深謝し、これからも顧客皆様への最大限の満足と利益の提供を追求して参りたいと、心を新たに決意しているところです。本年につきましても、引き続き変わらぬご指導とご厚誼を賜りますよう、何卒、よろしくお願い申し上げます。

本年、当所は創業五十周年という大きな節目を迎えることとなります。半世紀もの長きにわたり知財の専門家集団として着実に歩みを進めてこられましたのは、クライアントの皆様の温かいご支援と、所員一人ひとりの不断の努力の賜物であります。改めて心より感謝を申し上げます。

昨今の社会情勢の変化は、まさに非線形的ともいえる激しさを見せております。こうした不透明な時代だからこそ、私たちは「変えるべきもの」と「守り抜くべきもの」を賢明に峻別していかなければなりません。五十年の歴史を通して培ってきた、クライアントの皆様と共に歩み、信頼を築くことを旨としてきた姿勢は、時代がどう変わろうとも決して揺るがせてはならない私たちの財産です。この普遍の礎を大切に継承しつつ、同時に、既存の枠組みにとらわれない柔軟な発想で、独自の価値を創造し続ける所存でございます。

国際分類第13-2026版対応の類似商品・役務審査基準および商品・サービス国際分類表の公表

ニース国際分類第13-2026版が２０２６年１月１日に発効することを受け、特許庁HPにおいて、国際分類第13-2026版対応の似商品・役務審査基準および商品・サービス国際分類表が公表された。
これらは、２０２６年１月１日以降の商標登録出願に適用される。

第13-2026版のポイント

• 「精油」について、その用途によって異なる区分に分類されることとなった（第12-2025版では全て第3類）。
• 「眼鏡」・「サングラス」・「コンタクトレンズ」等について、第9類から、人の機能又は状態の改善のための商品として第10類へ移行された。
• 「電熱式被服」（靴下、フットマフ等含む）について、暖房機器を含む第11類から、一般の被服の分類である第25類へ移行された。

ブルーレイ私的録画補償金の徴収開始について

２０２５年９月２日付けで文化庁及び経済産業省より対象機器販売店に対して通知がなされた通り、２０２５年１２月１日より、ブルーレイディスク（BD)レコーダー及び録画用ブルーレイディスクを対象とする私的録画補償金の徴収が開始された。

これにより、BDレコーダー購入時には１台あたり税込200円（税抜182円）、録画用BDディス購入時には基準価格の1％（税抜）が、製品価格に上乗せされて徴収され、著作権者への分配や著作権保護事業に充てられることとなった。

BDレコーダー自体が現在ではあまり販売されておらず、録画用BDの需要も限られているため、実際に徴収される補償金総額はさほど多くない見込みであるなど、いくつかの課題が指摘されているものの、今般の徴収開始によって長らく空白だったBD録画分野の権利者補償が実現されることとなった。

＜私的録音録画補償金制度＞
「私的録音録画補償金制度」とは、デジタル方式の録音や録画によって発生する著作権者、実演家、レコード製作者の経済的不利益を補償するため、権利者の許諾なく行われる私的使用目的のデジタル方式の録音・録画について、録音・録画を行う者が補償金を支払わなければならないこととする制度である（著作権法第30条第3項）。
録音・録画技術の発達普及により、録音・録画が家庭内において容易に行われるようになり、社会全体として大量の録音・録画物が作成される事態に至っていることから、利用者が録音・録画機器等の購入時に補償金額を一括払いするという方法により、「私的複製（許諾不要）」と「権利者への対価還元」のバランスを実現することを目的としている。
支払いの対象となる機器及びそれに供する記録媒体は政令によって定められており、また、私的録音録画補償金を受ける権利を有する団体は、文化庁長官から指定された団体に限られており（著作権法第104条の2）、現在は一般社団法人私的録音録画補償金管理協会（sarah）が指定されている。

「2025年度知的財産権制度入門テキスト」の公表

２０２５年１２⽉に特許庁から「2025年度知的財産権制度入門テキスト」が公表された。本書は、令和７年９月１日時点で施行・運用されている最新の法律に基づき、特許・実用新案・意匠・商標の「産業財産権」を網羅的に解説した公的な標準テキストである。

意匠／商標制度の概要、登録要件、権利取得までの流れ、外国での権利取得、出願書類等の様式など、図解とともに、具体的な実務情報も記載されている。参照にされたい。

New Year’s greetings

I would like to wish you a very happy New Year.

This past year saw the near conclusion of Israel’s offensive in the Palestinian Gaza Strip. We also witnessed the intensification of Russia’s invasion of Ukraine, the escalation of international tensions between China and Japan over the Taiwan issue, and the increasing centralization of the United States under President Trump’s high-tariff and “America First” policies. The world’s political and economic landscapes are facing an uncertain and challenging era, in which self-serving actions of the so-called “great powers” are pervasive. We cannot help but hope that “world peace” will arrive as soon as possible.

Meanwhile, our firm, much like the previous year, experienced steady growth and enjoyed a “brilliant year” marked throughout by prosperity and busyness. I would like to extend my deepest gratitude to all our clients and every member of our firm. Thank you sincerely. Remembering our humble beginnings, we remain ever grateful for our clients’ continued patronage, and with renewed determination, we shall continue striving to maximize all our clients’ satisfaction and benefit. Publication of Examination Guidelines for Similar Goods and Services and International Classification Table of Goods and Services (corresponding to Nice Classification, 13th Edition, Version 2026)

In response to the enforcement of the Nice International Classification, 13th Edition, Version 2026 on January 1, 2026, the Japan Patent Office (JPO) has published on its website the Examination Guidelines for Similar Goods and Services and International Classification Table of Goods and Services (corresponding to the Nice Classification, 13th Edition, Version 2026).
These will apply to trademark registration applications filed on or after January 1, 2026.

Main Revisions in the 13th Edition, Version 2026 are as follows.

Key Points of the 13th Edition, Version 2026

• Concerning “essential oils”, classification will now vary depending on their intended use (in the 12th Edition, Version 2026, all were in Class 3).
• “Eyeglasses / spectacles”, “sunglasses”, and “contact lenses”, etc., have been transferred from Class 9 to Class 10, as goods intended to improve human functions or conditions.
• “Electrically heated clothing” (including socks, foot muffs, etc.) has been transferred from Class 11, which includes heating apparatuses, to Class 25, which covers general clothing.

Commencement of Compensation Collecting for Private Recordings to Blu-ray

On September 2, 2025, the Agency for Cultural Affairs and the Ministry of Economy, Trade and Industry notified retail stores handling relevant devices that the collection of private recording compensation would apply to Blu-ray Disc (BD) recorders and recordable Blu-ray Discs. Collection of this compensation began on December 1, 2025.

As a result, a compensation fee of 200 yen (182 yen before tax) per unit is added to the product price and collected when purchasing a BD recorder, and 1% (excluding tax) of the standard price is added to the product price and collected when purchasing a recordable BD,. The collected funds will be distributed to copyright holders and used for copyright protection projects.

The total amount of compensation collected is expected to be rather modest due to several issues that have been pointed out, such as the limited sales of BD recorders and the limited demand for recordable BDs. Nevertheless, the start of this collection implements the long-awaited compensation for rights holders in the BD recording field, which had long remained unaddressed.

Private Audio and Video Recording Compensation System
The “Private Audio and Video Recording Compensation System” is a system which requires persons who make digital audio or video recordings for private use without authorization from rights holders to pay compensation in order to offset the economic disadvantages suffered by copyright holders, performers, and record producers due to digital recording and reproduction (Copyright Act, Article 30, Paragraph 3).
With the advancement and widespread adoption of audio and video recording technologies, it has become easy to make recordings at home, resulting in the mass creation of recordings throughout society. Therefore, this method of requiring users to make a lump-sum payment of the compensation fee when purchasing recording devices, etc. aims to balance private copying (which does not require authorization) and “return of compensation to rights holders”.
The devices and recording media subject to such payments are stipulated by government ordinance, and only organizations designated by the Commissioner of the Agency for Cultural Affairs are entitled to receive private audio and video recording compensation (Copyright Act, Article 104-2). Currently, the designated organization is the Society for Administration of Remuneration for Audio Home Recording (sarah).

Publication of “2025 Intellectual Property Rights System Introductory Textbook”

In December 2025, the Japan Patent Office (JPO) published the “2025 Intellectual Property Rights System Introductory Textbook.” This official standard textbook provides a comprehensive explanation of “industrial property rights,” including patents, utility models, designs, and trademarks, based on the laws in effect and operation as of September 1, 2025.

The textbook is a useful reference that includes overviews of the design and trademark systems, registration requirements, procedures up to the acquisition of rights, acquisition of rights abroad, application document formats, and other practical information, accompanied by diagrams.
