第16回日ASEAN特許庁長官会合とSingapore IP Week 2026

8月26日に、日本国特許庁(JPO)と東南アジア諸国連合(ASEAN)各国の知財庁による第16回日ASEAN特許庁長官会合がシンガポールで開催された。

本会合では、JPOとASEAN各国知財庁との間で日ASEAN知財アクションプラン2026-2027が合意されたほか、東アジア・ASEAN経済研究センター(ERIA)から、ASEAN各国と協力して実施しているブランディング戦略にかかる調査、及びASEAN加盟国の半導体サプライチェーンに関する調査について中間報告、並びに医薬等の注目技術の特許審査に関する調査について最終報告が行われた。併せて2026年度に新たに開始される調査について紹介された。

また、インドネシア、マレーシア、デンマーク、フィリピン、タイ、ラオス、シンガポール、カンボジアと会談を行い、引き続き二国間の協力を進めていくことを確認した。

ERIAは、2008年6月にジャカルタに設立された国際的研究機関であり、東アジア16ヵ国(ASEAN・日・中・韓・印・豪・NZ)における経済統合の深化、開発格差の是正、持続可能な経済成長に向けた政策研究及び政策提言を行っている。

さらに、8月27日、シンガポール知的財産庁(IPOS)主催のイベント「Singapore IP Week 2026」において、河西長官が特別講演に登壇するとともに、サイドイベントとして、日本国特許庁(JPO)とJETROシンガポール事務所の共催によるジャパン・セッションを開催した。Singapore IP Weekには50を超える国・地域から知財関係者が集まり、世界の知財関係者の交流の場となる国際的なプラットフォームとなっている。

河西長官による特別講演では、「Adapting to the AI Era: How the JPO Is Evolving(AI時代への適応:JPOはどのように進化しているのか)」と題し、JPOにおけるAI関連のこれまでの取組や今後の方向性などが紹介された。

また、ジャパン・セッションでは、「Changing Japan, Growing Collaboration(変わる日本、広がる共創)」をテーマに、JPO及びIPOSにおける企業成長のための取組の紹介に加え、企業関係者による講演や、有識者を交えたパネルディスカッションが行われた。知的財産が企業成長に果たす役割や、日シンガポール間の連携の可能性等について活発な議論が交わされ、ジャパン・セッションには対面・オンライン合わせて130名以上が参加するなど、高い関心が寄せられた。

 

ミュンヘン第一地方裁判所によるFRANDガイドライン

ドイツのミュンヘン第一地方裁判所(Landgericht München I)第7民事部は、2026年8月に標準必須特許(SEP)のライセンス交渉及び訴訟におけるFRAND条件の判断について、新たなガイドラインを公表した。

本ガイドラインは法令又は上級審判例ではなく、同第7民事部の審理方針を示すものだが、同部は多数のSEP事件を取り扱っているため、今後のドイツにおけるSEPライセンス交渉・訴訟実務への影響が注目されている。

同ガイドラインは、近時の複数のSEP/FRAND訴訟における同部のアプローチを要約し、さらなる明確化を行うとともに、公表された判決が存在しない手続において生じた論点を取り上げている。

本ガイドラインでは、実施者のライセンス意思を、①外形的ライセンス意思(現実にライセンスを取得する意思を示しているか)、②内容的ライセンス意思(SEP権利者から提示されたFRAND条件を実際に受け入れる意思があるか)の二段階で判断する。

特に①について、単に「FRAND条件ならライセンスを受ける」と表明するだけでは足りず、原則として、実施者自身が支払うべきと考えるロイヤルティ額(カウンターオファー相当額)をSEP権利者に実際に支払うことが重視されている。また、追加的な担保提供が必要となる具体的な基準が示された。

さらに、SEP権利者の提示条件がFRANDであるかについては、まず比較可能な既存ライセンス契約(Comparable Licenses)を重視し、Top-downアプローチを補完的に用いる考え方が示されている。

 

令和8年度特許審査の質についてのユーザー評価調査報告書

特許庁は、令和8年度調査の結果を報告書に取りまとめた。特許審査に対するユーザー(出願人や権利を行使される第三者等)のニーズや期待を適切に把握することが不可欠であるとの認識のもと、特許庁は、平成24年度より特許審査の質についてのユーザー評価調査を実施している。

本報告書は、令和7年度の特許審査・国際調査等全般の質について「満足」、「比較的満足」、「普通」、「比較的不満」、「不満」の5段階で評価した結果を取りまとめたもの。調査は令和8年4月~6月に実施し、回答率は約8割となった。

国内出願における特許審査全般の質についての評価(全体評価)は、上位評価割合(「満足」・「比較的満足」の評価の割合)が61.9%、「普通」以上の評価の割合が96.3%であった。

PCT出願における国際調査等全般の質についての評価(全体評価)は、上位評価割合が60.5%、「普通」以上の評価の割合が99.1%であった。

分析の結果、国内出願において、「判断の均質性」、「第29条第2項(進歩性)の判断の均質性」の項目が、全体評価への影響が大きく、かつ相対的な評価が低いため、これらを優先的に取り組むべき項目と設定した。

特許庁は、今後も、審査に関する統計データを活用しつつ、審査官間の協議等を通じた審査官相互の知識の共有を進め、判断の均質性の向上に取り組むとしている。

 

USPTO 特許審判部(PTAB)を巡る状況と関連動向

USPTO 特許審判部(PTAB)では、2025年3月の PTAB 業務管理に関するメモの発出以降、審理開始割合が低下しており、これを受けてPTABにおける当事者系レビュー(IPR)請求件数も減少傾向にあった。2026年6月や7月は、対象件数が限定的であることもあり審理開始割合が50%を超えたものの、2026年度全体での審理開始割合は40%を下回る低水準に留まっており、引き続き審理開始が拒否されやすい状況が続いている。

また、2026年度におけるIPR請求件数についても、2025年10月の90件が最多であり、直近でも6月が22件、7月が31件と減少傾向が継続している。2026年度累計での請求件数も386件に留まり、前年同時期における累計請求件数(1,150件)に比して66.4%減と大幅に減少している状況にある。

他方、査定系再審査手続(Ex Parte Reexamination: EPR)請求件数の推移は、IPR請求動向とは大きく傾向が異なる。PTAB業務管理に関するメモが発出された2025年度第3四半期以降、IPR請求件数の減少とは反対に、EPR請求件数は大幅に増加しており、IPR請求の代替手段としての活用が進められているとする見方がある。

USPTOは、EPRについても、再審査実施の要件である特許性に関する実質的な新たな疑義(a Substantial New Question: SNQ)の有無に関して新たに特許権者による意見提出の機会を設け、また、匿名でも請求可能であるEPRについて第三者による請求の場合には USPTO に対して利害関係者の情報開示を義務化する規則改正案に関して意見募集を行うなど、運用の見直しに向けた検討を進めている。

PTABにおける今後の審理開始割合の推移を含む運用・判断動向とともに、その代替手段としてのEPRに関する運用の見直しとその請求動向に与える影響も注目される。

The 16th Japan-ASEAN Heads of Intellectual Property Offices Meeting and Singapore IP Week 2026

On August 26, 2026, the 16th Japan-ASEAN Heads of Intellectual Property Offices Meeting between the Japan Patent Office (JPO) and the intellectual property offices of the Association of Southeast Asian Nations (ASEAN) member states was held in Singapore.

At this meeting, the JPO and the ASEAN IP offices agreed on the Japan-ASEAN IP Action Plan 2026-2027. Additionally, the Economic Research Institute for ASEAN and East Asia (ERIA) delivered interim reports on a study on branding strategies conducted in cooperation with ASEAN countries and a study on semiconductor supply chains in ASEAN member states. ERIA also presented a final report on a study regarding patent examination of technologies of interest, such as pharmaceuticals. Furthermore, studies to be newly launched in fiscal year 2026 were introduced.

In addition, meetings were held with Indonesia, Malaysia, Denmark, the Philippines, Thailand, Laos, Singapore, and Cambodia, where the participants confirmed that they would continue to advance bilateral cooperation.

ERIA is an international research institute established in Jakarta in June 2008. It conducts policy research and provides policy recommendations aimed at deepening economic integration, narrowing development gaps, and achieving sustainable economic growth across 16 East Asian countries (ASEAN, Japan, China, South Korea, India, Australia, and New Zealand).

Furthermore, on August 27, 2026, JPO Commissioner Kasai delivered a special speech at “Singapore IP Week 2026,” an event hosted by the Intellectual Property Office of Singapore (IPOS). Alongside this, a “Japan Session” was held as a side event, co-hosted by the JPO and the JETRO Singapore office. Singapore IP Week attracted IP professionals from over 50 countries and regions, serving as an international platform that facilitates networking among IP stakeholders from around the world.

In the special speech by Commissioner Kasai, titled “Adapting to the AI Era: How the JPO Is Evolving,” past AI-related initiatives and future directions of the JPO were introduced.

In the Japan Session, which had the theme “Changing Japan, Growing Collaboration,” initiatives by the JPO and IPOS to foster corporate growth were introduced. This was accompanied by presentations from business representatives and a panel discussion featuring experts. Active discussions took place on the role of intellectual property in corporate growth and the potential for collaboration between Japan and Singapore. The Japan Session drew significant interest, with over 130 participants attending both in person and online.

 

FRAND Guidelines by the Munich I Regional Court

In August 2026, the 7th Civil Chamber of the Munich I Regional Court (Landgericht München I) in Germany published new guidelines on the determination of FRAND terms in licensing negotiations and litigation involving standard essential patents (SEPs).

Although these guidelines are not statutory laws or upper court precedents but rather indicate the trial policy of the 7th Civil Chamber, their impact on future SEP licensing negotiation and litigation practices in Germany is drawing attention, as the Chamber handles a large number of SEP cases.

The guidelines summarize and further clarify the Chamber’s approach in several recent SEP/FRAND lawsuits, and address issues that arose in proceedings where no published judgments exist.

Under these guidelines, an implementer’s willingness to license is evaluated in two stages: (1) external willingness to license (whether they have demonstrated an actual willingness to obtain a license), and (2) substantive willingness to license (whether they are actually willing to accept the FRAND terms proposed by the SEP holder).

Particularly regarding (1), it is emphasized that merely declaring a willingness to take a license “on FRAND terms” is insufficient. In principle, importance is placed on the implementer actually paying the SEP holder the royalty amount they believe they should pay (equivalent to a counter-offer). Furthermore, specific criteria requiring the provision of additional security were presented.

Regarding whether the terms offered by the SEP holder are FRAND, the guidelines indicate an approach that prioritizes comparable existing license agreements (Comparable Licenses), with a top-down approach being used complementarily.

 

Fiscal Year 2026 Report on the User Evaluation Survey on Patent Examination Quality

The Japan Patent Office (JPO) has compiled the results of the fiscal year 2026 survey into a report. Recognizing that it is essential to properly understand the needs and expectations of users (such as applicants and third parties against whom rights are enforced) regarding patent examination, the JPO has been conducting the User Evaluation Survey on Patent Examination Quality since fiscal year 2012.

This report compiles the evaluation results of the overall quality of patent examinations and international searches in fiscal year 2025, using a five-level scale of “Satisfied,” “Somewhat Satisfied,” “Neutral,” “Somewhat Dissatisfied,” and “Dissatisfied.” The survey was conducted from April to June 2026, with a response rate of approximately 80%.

Regarding the evaluation of the overall quality of patent examinations for national applications (overall evaluation), the high evaluation rate (the percentage of “Satisfied” and “Somewhat Satisfied” evaluations) was 61.9%, and the percentage of “Neutral” or higher evaluations was 96.3%.

As for the evaluation of the overall quality of international searches and related procedures for PCT applications (overall evaluation), the high evaluation rate was 60.5%, and the percentage of “Neutral” or higher evaluations was 99.1%.

As a result of the analysis, because the items “consistency of decisions” and “consistency of decisions on Article 29, Paragraph 2 (inventive step)” in national applications had a large impact on the overall evaluation and their relative evaluations were low, the JPO designated these as priority items to address.

The JPO stated that it will continue to work on improving the consistency of decisions by utilizing statistical data on examinations and promoting the sharing of mutual knowledge among examiners through examiner consultations and other means.

 

Status and Related Trends Regarding the USPTO Patent Trial and Appeal Board (PTAB)

At the USPTO Patent Trial and Appeal Board (PTAB), the institution rate has been declining since the issuance of the memo on PTAB operations management in March 2025. Consequently, the number of petitions for Inter Partes Review (IPR) at the PTAB has also been on a downward trend. Although the institution rate exceeded 50% in June and July 2026, partly due to the limited number of target cases, the overall institution rate for fiscal year 2026 remains at a low level of under 40%, indicating a continuing trend where institution is easily denied.

Furthermore, regarding the number of IPR petitions in fiscal year 2026, the peak was 90 petitions in October 2025, and the declining trend continues recently with 22 petitions in June and 31 petitions in July. The cumulative number of petitions for fiscal year 2026 remains at 386, representing a significant decrease of 66.4% compared to the cumulative number of petitions (1,150) during the same period of the previous year.

On the other hand, the trend in the number of requests for Ex Parte Reexamination (EPR) differs significantly from the trend in IPR petitions. Since the third quarter of fiscal year 2025, when the memo on PTAB operations management was issued, the number of EPR requests has increased significantly, in contrast to the decline in IPR petitions, leading to the view that EPR is increasingly being utilized as an alternative to IPR.

The USPTO is also considering revisions to EPR operations. For instance, the USPTO has proposed providing patent owners with a new opportunity to submit statements regarding whether there is a Substantial New Question (SNQ) of patentability, which is a requirement for conducting a reexamination. Furthermore, while EPR can be requested anonymously, the USPTO has sought public comments on a proposed rule change that would require third-party requesters to disclose real party-in-interest information to the USPTO.

In addition to future trends in the institution rate, operations, and decisions at the PTAB, close attention is being paid to the revisions of EPR operations as an alternative and the impact these revisions will have on EPR request trends.
