意匠制度小委員会(7月29日)が示すデザイン保護の方向性
近年、VRやAR技術の進展に伴い、仮想空間(メタバース)における3Dモデルやアバター、仮想空間そのもの(ワールド)の取引が活発化している。
これを受け、特許庁の意匠制度小委員会は、7月29日、仮想空間におけるデザイン保護を目的とした、意匠法改正の方向性について公表した。
これは、今後の知財実務、特に、デジタルコンテンツの権利化や他社権利調査に、重要な影響を及ぼすため、その骨子を解説する。
保護対象の拡張:アバターや「ワールド」も意匠法の保護視野に
従来の検討では、画像意匠の保護対象について、従来の意匠法の延長である「物品」または「建築物」の形状を模したものに限定する方針であった。
しかし、事業者からの強い保護要求を踏まえ、「画像として表される対象を、物品及び建築物に限定しない方向性」が提示された。
これにより、アバター(キャラクター)や仮想空間の店舗内装(ワールド)なども、意匠権での保護が可能となる。
類否判断のアプローチ:「画像の用途・機能」への着目
意匠の類否判断において、単に、形状の類似のみで判断すると(B案)、全く異なるサービスにまで権利が及び、クリアランス(他社権利調査)の負担が過度に増大する。
一方で、従来の厳密な物品単位の用途に固執すると(A案)、意匠権としての模倣対策の実効性が著しく損なわれる。
この課題に対し、新たに「3Dモデルが表示される画像が、どのようなサービスにおいて、どのような用途・機能を果たしているか」に着目して類否判断を行う、ハイブリッドな中間案が提案された。これにより、権利の実効性とクリアランス調査負担のバランスを取る狙いである。
「実施行為」の画定と今後の実務への影響
「制作」「流通」「使用」の各段階における、意匠権の効力が及ぶ範囲(実施行為)についても整理が進められた。
創作者の創作活動を萎縮させないよう配慮しつつ、プラットフォーム上での3Dモデルの流通(データ提供)段階を、効果的に規制する方向で調整が進められている。
「実施行為」については、上記の「保護対象」と「類否判断」の枠組みが整理された後に、最終的な検討が行われる見込みだ。
■ 今後の展望と実務上の留意点
次回は令和8年秋頃に、生成AI技術の進展を踏まえた対応も含め、さらに具体的な法改正の枠組みが議論される予定である。メタバース領域への事業展開を検討する企業、あるいはすでにアバターや3Dオブジェクトの制作を行っている事業者においては、今後の法改正の動向を注視し、早期の知財戦略への反映を推奨する。

審判便覧改訂案:コンセント制度・アサインバックに伴う「混同防止の取消審判」の運用の追加
特許庁は、近年の法改正に伴う実務運用の変更等を反映させるため、審判便覧の改訂案を公表し、意見募集(パブリックコメント)を開始した。今回の改訂は多岐にわたるが、商標実務において特に注目すべきは、「類似商標の移転等に伴う混同防止の取消審判(53―04)」における改訂である。
本改訂案では、コンセント制度および「アサインバック」の手法により、複数の類似する登録商標に係る商標権が異なる者に属することとなった場合についても、混同防止の取消審判を請求できる旨が追加された。
改訂の背景と追加内容
コンセント制度やアサインバックに伴う「混同防止の取消審判」の適用拡大は、2023年の商標法改正(令和5年法律第51号、令和6年4月1日施行)によって、商標法第52条の2第1項に規定された。今回の改訂案は、この法改正を反映したものである。
コンセント制度の導入に伴い、先行登録商標と類似する商標であっても、混同のおそれがない等一定の要件を満たせば並存登録が可能となった。また実務上は、コンセント制度の導入以前より、出願人と先行登録商標の権利者の名義を一時的に一致させて拒絶理由を解消した後に商標権を移転(返還)させる「アサインバック」の手法も活用されている。
しかし、並存登録後にいずれかの商標権者が不正競争の目的で商標を使用し、他方の業務に係る商品や役務と混同を生じさせた場合の担保措置が不可欠である。そのため、上記の手法によって類似商標の商標権者が分かれた場合であっても、不正な混同惹起行為があった際には、何人もその商標登録の取消を求める審判を請求できることが、今回の便覧改訂で改めて実務手順として記載される。
今後のスケジュール
上記の内容を含む審判便覧改訂案にかかる意見募集は、2026年9月11日まで行われる。意見募集の終了後、提出された意見を参考に特許庁において最終的な成案が作成され、2026年中に改訂・適用される予定である。

国立アートリサーチセンター、パブリックドメイン作品の無償ダウンロード提供を開始
独立行政法人国立美術館 国立アートリサーチセンター(National Center for Art Research、略称:NCAR)(東京都千代田区)は、2026年5月29日から、「所蔵作品総合目録検索システム(5館総合目録)」において、国立美術館5館の所蔵作品のうち、著作権保護期間が満了した作品(パブリックドメイン)の画像データの無償ダウンロード提供を開始した。
東京国立近代美術館、国立工芸館(金沢)、京都国立近代美術館、国立西洋美術館(東京)、国立国際美術館(大阪)の所蔵作品のうち12,190作品の画像データ計14,063点が提供される。
これにより、国立美術館が所蔵するパブリックドメイン作品が、教育・研究現場や創作活動など幅広い用途で活用されることが期待される。
パブリックドメイン
著作物の保護期間は、現行の日本の著作権法では原則として「創作の時から、著作者の死後70年を経過するまでの間」であり、保護期間が満了した著作物は「パブリックドメイン」と位置づけられ、公共的な財産となる。また、著作者が著作権を放棄した場合や相続人が不在の場合も同様で、パブリックドメインとなる。
ただし、パブリックドメインの作品であっても著作者人格権は消滅しない点に注意が必要である。

Direction of Design Protection Indicated by the Design System Subcommittee (July 29)
In recent years, with the development of VR and AR technologies, transactions of 3D models, avatars, and virtual spaces (worlds) themselves in the metaverse have been increasing.
In response to this, on July 29, the Design System Subcommittee of the Japan Patent Office published information regarding the direction of Design Act amendments aimed at protecting designs in virtual spaces.
Since this will significantly affect future IP practices, particularly the acquisition of rights for digital content and searches of third-party rights, the outline of the publication is explained in this article.
Expansion of the Scope of Protection: Avatars and “Worlds” Also within the Scope of Protection under the Design Act
In conventional discussions, the policy was to limit the scope of protection for graphic image designs to those imitating the shapes of “articles” or “buildings”, which is an extension of the existing Design Act.
However, based on strong requests for protection from business operators, “an approach of not limiting the subjects represented as images to articles and buildings” was proposed.
This will enable the protection of avatars (characters), virtual store interiors (worlds), and other such elements under design rights.
Approach to Similarity Judgment: Focus on the “Use and Function of Images”
In judging the similarity of designs, simply basing the judgment on only the similarity of shape (Proposal B) will extent the right even to completely different services, excessively increasing the burden of clearance (search of third-party rights).
On the other hand, if adhering to the conventional strict unit-of-article use (Proposal A), the effectiveness of measures against imitation under design rights will be significantly impaired.
To address this issue, a hybrid intermediate proposal was newly made whereby similarity is judged by focusing on “what kind of service the image displaying the 3D model is used in, and what kind of use and function it performs.” The aim of this proposal is to strike a balance between the effectiveness of rights and the burden of clearance searches.
Definition of “Acts of Exploitation” and Future Impact on Practice
Progress was also made on organizing the scope to which the effects of design rights extend (acts of exploitation) at each stage of “production”, “distribution”, and “use”.
Adjustments are being made with a focus on effectively regulating the distribution (data provision) stage of 3D models on platforms, while taking care not to discourage the creative activities of creators.
Regarding “acts of exploitation”, final consideration is expected to be carried out after the frameworks for the “scope of protection” and “similarity judgment” mentioned above are organized.
■ Future Outlook and Practical Points to Note
Next time, around the autumn of 2026, a more concrete framework for legal amendments will be discussed, including responses that take into account the development of generative AI technology. For companies considering business expansion into the metaverse domain, or operators already producing avatars and 3D objects, it is recommended to closely monitor trends in future legal amendments and reflect them in their intellectual property strategies at an early stage.

Draft Revision of Manual for Appeal and Trial Proceedings: Operations Added for “Trial for Cancelation to Prevent Confusion” in Connection with Consent System and Assign-back
The Japan Patent Office (JPO) published a draft revision of the Manual for Appeal and Trial Proceedings and began inviting public comments in order to reflect changes in practical operations and other aspects resulting from recent legal amendments. Although this revision covers a wide range of areas, what is particularly noteworthy in trademark practice is the revision of “Trial for Cancelation of Trademark Registration to Prevent Confusion in Connection with Transfer, etc. of Similar Trademarks (53-04)”.
In this draft revision, it has been added that a trial for cancelation to prevent confusion can be requested also in cases where trademark rights relating to multiple similar registered trademarks have come to belong to different persons as a result of the consent system or the “assign-back” method.
Background and Details of the Revision
The expansion of the applicability of the “trial for cancelation to prevent confusion” in connection with the consent system and assign-back was stipulated in Article 52-2, Paragraph 1 of the Trademark Act by the 2023 Trademark Act Amendment (Act No. 51 of 2023, enforced on April 1, 2024). The current draft revision reflects this legal amendment.
With the introduction of the consent system, even a trademark that is similar to a prior registered trademark can now be registered concurrently, provided that certain requirements are met, such as there being no likelihood of confusion. In addition, in practice, even before the introduction of the consent system, the “assign-back” method has been utilized, in which the names of the applicant and the owner of the prior registered trademark are temporarily matched via a change of applicant to resolve the reasons for refusal, and then the trademark right is transferred (returned).
However, collateral measures are essential in cases where, after concurrent registration, either trademark owner uses the trademark for the purpose of unfair competition and causes confusion with the goods or services pertaining to the business of the other owner. Therefore, even if the similar trademarks come to have different owners through the above methods, this manual revision newly indicates, as a practical procedure, that any person may request a trial for cancelation of the trademark registration when an act causes unfair confusion.
Future Schedule
The invitation for public comments on the draft revision of the Manual for Appeal and Trial Proceedings, which includes the details mentioned above, will be held until September 11, 2026. After the end of the public comment period, the JPO will prepare the final draft with reference to the submitted opinions, and the revision is scheduled to be implemented/applied within 2026.

National Center for Art Research Starts Providing Free Downloads of Public Domain Works
The National Center for Art Research (NCAR) (Chiyoda-ku, Tokyo) of the Independent Administrative Institution National Museum of Art started providing free downloads of image data of works whose copyright protection periods have expired (public domain) among the collection of the five national museums of art, via the “Union Catalogue of the Collections of the National Art Museums, Japan” search system from May 29, 2026.
A total of 14,063 items of image data for 12,190 works among the collections of the National Museum of Modern Art (Tokyo); the National Crafts Museum (Kanazawa); the National Museum of Modern Art (Kyoto), the National Museum of Western Art (Tokyo); and the National Museum of Art (Osaka) will be provided.
This is expected to facilitate the utilization of public domain works held by the national museums of art in a wide range of applications, such as educational and research settings and creative activities.
Public Domain
Under the current Copyright Act of Japan, the protection period for a work is in principle “from the time of creation until 70 years have passed after the death of the author”. Works for which the protection period has expired are positioned as “public domain” and become public assets. The same applies when the author waives the copyright or when there is no heir, and the work becomes part of the public domain.
However, it should be noted that moral rights of authors do not expire even for public domain works.
