特許行政年次報告書2026年版

 特許庁は、7月27日に特許行政年次報告書2026年版を取りまとめたと発表した。

 特許行政年次報告書2026年版によると、日本国特許庁への特許出願件数は、2020年以降横ばい傾向であったが、2025年は前年比16.8%増の358,317件であった。また、日本国特許庁を受理官庁とした特許協力条約に基づく国際出願(PCT国際出願)の件数は、2025年は46,305件となり、前年(2024年)の46,751件よりも減少しているものの、依然として高い水準を維持している。審査請求件数は横ばいで推移しており、2025年は223,235件であった。

 また、特許庁は、2024年度以降の目標として、10年後の2033年度においても特許の「権利化までの期間」を平均14か月以内に維持するという目標を設定している。

 ここで、特許行政年次報告書2026年版によると、2025年度の特許の「権利化までの期間」は、平均13.2か月であり、2025年度の「一次審査通知までの期間」は、平均9.4か月であった。よって、2025年度における「権利化までの期間」および「一次審査通知までの期間」は、2024年度の特許の「権利化までの期間」:平均13.0か月および「一次審査通知までの期間」:平均9.1か月と同程度の高い水準で維持されていた。

 特許行政年次報告書2026年版によると、特許登録件数は、近年は18万件前後で推移している。また、特許出願件数に対する特許登録件数の割合(特許登録率)は増加傾向にあり、2025年では76.5%であった。

 これらの傾向から、出願人による特許出願の厳選が進んでいることや、企業等における知的財産戦略において量から質への転換が着実に進んでいることが窺える。

 日本から海外への特許出願件数は、2014年以降ほぼ横ばいで推移していたが、2020年以降は減少傾向にある。外国人による日本での特許登録件数は、米国、欧州、中国、韓国の各地域で2020年以降増加傾向にあり、米国が35.1%、欧州が29.0%、中国が16.3%、韓国が12.7%となっている。

 

 

タイ知的財産局(DIP)の審査官に対する特許審査実務研修

 2026年7月15日から21日までのうち計5日間、日本国特許庁(JPO)は、タイ知的財産局(DIP)の特許審査官に対し、新人向けの特許審査実務研修のフォローアップの位置づけとなる研修を実施した。

 また、JPOは、DIPの特許審査官に対して、同時に、2026年7月15日から17日の計3日間でグリーンテクノロジー分野における特許審査実務研修を実施し、2026年7月17日から21日までのうち計3日間で化学分野における特許審査実務研修を実施した。

 なお、JPOは、2023年および2024年にも、DIPの特許審査官に対して同様の研修を実施していた。

 前記研修では、講師と受講生との対面形式で、実案件を用いたケーススタディを通して、特許審査における先行技術調査の手法および新規性・進歩性の判断等について講義が行われた。

 受講生は、前記研修について、例えば、以下に示す感想を示した。

・講師は高度な知識を有しており、複雑な特許審査の概念を分かりやすく説明するとともに、実務に即した具体例を示してくれた。

・本研修は特許審査官の実務に直接活用できる内容であった。ケーススタディは実践的で興味深いものだった。

 前記研修の結果、グリーンテクノロジー分野および化学分野において、日本国で特許を取得した企業が、タイでも特許取得を目指す場合に、例えば、以下に示す利点が発生する可能性があると考えられる。

・JPOの審査手法を、海外の途上国の特許審査官に浸透させることにより、JPOの審査に対する信頼性が向上し、JPOで特許となった発明について、そのままタイで特許される可能性が向上する。また、タイの審査官の審査能力が向上し、審査が迅速化する。これらのことにより、日本国で特許を取得した企業が、タイにおいても、円滑かつ迅速に、当該特許を取得することが可能となる。

 

 

「JPO AIビジョン」の公表

 日本国特許庁は、2026年7月27日に、人間中心の原則の下、リスクに適切に対応しながらAI活用を進め、高品質・迅速な行政サービスを提供するという基本的な方向性を示す「JPO AIビジョン」を策定・公表した。

 今後、前記「JPO AIビジョン」に沿って、特許庁の行政サービス、例えば、審査等において、AIの導入および活用が促進される見込みである。

 前記「JPO AIビジョン」の内容は以下の通りである。

目標

・高品質・迅速な行政サービスの提供

・責任あるAI活用

・AI活用エコシステムの基盤強化

 

キーコンセプト①:AI活用の促進

・AI活用の加速:積極的なAI活用を進めること。

・最新の技術動向を踏まえた最適なAI活用:AIの進展の継続的な把握および適切で効果的なAI活用方法の模索を進めること。

・アジャイルなAI活用:AI活用計画の随時見直しを行うこと。

 

キーコンセプト②:人間中心のAI

・職員の関与:AIの出力結果に対して職員による検証および最終判断を行うこと。

・透明性:AIを活用しているプロセス等の必要かつ可能な範囲の情報を開示すること。

・アカウンタビリティ:AIが生成した情報に基づくサービスについての説明責任を特許庁が果たすこと。

 

キーコンセプト③:リスクへの適切な対処

・機密情報漏洩の防止:AIの出力結果からの機密情報漏洩を防止する対策を講じること。

・リスクの想定:AIによるリスクの洗い出しおよび対応の事前検討を行うこと。

 

キーコンセプト④:ステークホルダーとの連携

・ユーザーとのコミュニケーション:日本国の知的財産等のユーザーとの継続的なコミュニケーションを実施すること。

・海外知財庁等との連携:海外知財庁との連携およびベストプラクティスの共有により、AI活用の効率的なあり方を模索すること。

・国内機関との協調:政府および関連機関の方針・方向性との整合性を確保すること。

・外部有識者との意見交換:AIに関する外部有識者との意見交換を実施し、アドバイスを受けることにより、より効果的なAI活用を目指すこと。

 

キーコンセプト⑤:AI活用のための組織作り

・業務・組織の改革:AIの効率的な活用、並びに、自由な発想で検討および議論ができるように、業務および組織を改革すること。

・AIガバナンスの構築:AIに関する事項を一元的に管理する組織を組成すること、および、AIに関する責任者を定めること。

・人材育成:職員全体のAIリテラシーの向上を図りつつ、新しいAI技術を随時導入できるようなAI専門人材を育成すること。

 

 

INPIT九州本部(INPIT-KYUSHU)の開設

 独立行政法人工業所有権情報・研修館(以下「INPIT」という。)は、2026年10月1日に、福岡市(具体的には、天神ビジネスセンターII(福岡県福岡市天神1-10-10))に新たな地域ブロックの拠点として、INPIT九州本部(INPIT-KYUSHU)を開設する。

 これは、日本国特許庁(JPO)とINPITが進めてきた、革新的な製品およびサービスを地域の付加価値創出につなげるため、重要な経営資源である知的財産が地域企業においても有効に活用されることを目的とする、INPITの機能の地方展開の取り組みの一環である。なお、今回のINPIT-KYUSHUの開設は、近畿ブロックの「INPIT-KANSAI」に次ぐ、全国2番目となる地域拠点の開設となる。

 INPIT-KYUSHUは、主に、以下の1.~3.に示す活動を行うことによって、九州地域における知財経営を支援し、企業等の稼ぐ力の向上を目指す。

  1. 「知財戦略エキスパート」による高度かつ迅速な伴走支援を提供する。
  2. 「知財経営支援ネットワーク」をはじめ自治体、支援機関、金融機関など、企業支援を担う関係機関との連携を強化し、広域・包括的な企業支援を進める。
  3. 地域の大学・研究機関等に対して、アカデミアにおける知財活用の重要性を発信するなど、知財リテラシーの向上に取り組む。

 前記1.に記載の「知財戦略エキスパート」とは、高度な知財戦略の知見と豊富な実務経験を有する専門支援人材である。

 前記2.に記載の「知財経営支援ネットワーク」とは、地域の中小企業・スタートアップへの知財経営支援の強化・充実化に取り組むため、JPO、中小企業庁、INPIT、日本弁理士会、日本商工会議所の5者により構築されたネットワークである。

Japan Patent Office Annual Report 2026

Therefore, the “period to patent acquisition” and the ” period to the first notice of examination results” in fiscal year 2025 were maintained at good levels, similar to the average “period to patent acquisition” of 13.0 months and the average ” period to the first notice of examination results ” of 9.1 months in fiscal year 2024.

According to the Japan Patent Office Annual Report 2026, the number of patent registrations has hovered around 180,000 in recent years. In addition, the ratio of patent registrations to the number of patent filings (patent registration rate) is on an upward trend, reaching 76.5% in 2025.

The number of patent registrations in Japan from non-Japanese applicants has been on an upward trend since 2020 for applicants in the US, Europe, China, and South Korea, with the US accounting for 35.1% of such registrations, Europe for 29.0%, China for 16.3%, and South Korea for 12.7%.

 

 

Patent Examination Practice Training for Examiners of the Department of Intellectual Property (DIP) of Thailand

For a total of five days between July 15 and 21, 2026, the Japan Patent Office (JPO) conducted training for patent examiners of the Department of Intellectual Property (DIP) of Thailand, which serves as a follow-up to the patent examination practice training for new examiners.

At the same time, the JPO conducted patent examination practice training in the field of green technology for three days (July 15 to 17, 2026), and patent examination practice training in the field of chemistry for a total of three days (July 17 and 21, 2026), for the patent examiners of the DIP.

The JPO also conducted similar training for the patent examiners of the DIP in 2023 and 2024.

During the training, lectures were provided in a face-to-face format between instructors and trainees on prior art search methodologies in patent examination and the assessment of novelty and inventive step through case studies using actual cases.

Trainees provided feedback on the training, such as the following:

・The instructors possess high-level knowledge and explained complex patent examination concepts in an easy-to-understand manner, while providing practical, concrete examples.

・This training was directly applicable to the practical work of patent examiners. The case studies were practical and interesting.

As a result of the training, when a company that has acquired a patent in Japan aims to acquire a patent in Thailand in the fields of green technology and chemistry, the following advantages may arise:

・Disseminating JPO examination methodologies to patent examiners in developing countries overseas enhances the reliability of JPO examinations. This increases the likelihood that an invention patented at the JPO will be patented in Thailand as-is.

・In addition, the examination capabilities of Thai examiners will be improved, leading to faster examinations. As a result, companies that have acquired patents in Japan will be able to smoothly and quickly acquire the patents in Thailand as well.

 

 

Publication of the “JPO AI Vision”

On July 27, 2026, the Japan Patent Office formulated and published the “JPO AI Vision,” which outlines the basic direction of promoting AI utilization while appropriately addressing risks under human-centric principles, in order to provide high-quality and prompt administrative services.

Going forward, the introduction and utilization of AI are expected to be promoted in the JPO’s administrative services, such as examination, in accordance with the “JPO AI Vision.”

The details of the “JPO AI Vision” are as follows:

・Responsible utilization of AI

・Strengthening the foundation of the AI utilization ecosystem

 

Key Concept 1: Promotion of AI Utilization

・Acceleration of AI utilization:Promotion of active AI utilization.

・Optimal AI utilization based on the latest technological trends:Continuous monitoring of developments in AI and seeking of appropriate and effective ways to utilize AI.

・Agile AI utilization:Reviewing AI utilization plans as needed.

 

Key Concept 2: Human-Centric AI

・Involvement of staff:Having staff verify and make final decisions on the output results of AI.

・Transparency:Disclosing necessary and possible information regarding the processes in which AI is utilized.

・Accountability:Ensuring the JPO fulfills its accountability for services based on information generated by AI.

 

Key Concept 3: Appropriate Response to Risks

・Prevention of confidential information leakage:Taking measures to prevent the leakage of confidential information from AI output results.

・Risk assumption:Identifying risks associated with AI and conduct preliminary reviews on countermeasures.

 

Key Concept 4: Cooperation with Stakeholders

・Communication with users:Engaging in continuous communication with users of intellectual property and other services in Japan.

・Cooperation with overseas IP offices, etc.:Seeking efficient ways of AI utilization through cooperation with overseas IP offices and sharing best practices.

・Cooperation with domestic institutions:Ensuring consistency with the policies and directions of the government and related institutions.

・Exchange of opinions with external experts:Exchanging opinions with and receiving advice from external experts on AI to aim for more effective AI utilization.

 

Key Concept 5: Organization Building for AI Utilization

・Reform of operations and organization:Reforming operations and the organization to enable efficient utilization of AI, as well as examination and discussion with free thinking.

・Establishment of AI governance:Forming an organization that centrally manages AI-related matters and designating persons responsible for AI.

・Human resource development:Fostering AI specialists who can introduce new AI technologies as needed, while striving to improve the overall AI literacy of staff.

 

 

Establishment of INPIT Kyushu Headquarters (INPIT-KYUSHU)

On October 1, 2026, the National Center for Industrial Property Information and Training (hereinafter referred to as ‘INPIT’) will establish the INPIT Kyushu Headquarters (INPIT-KYUSHU) in Fukuoka City (specifically at the Tenjin Business Center II, 1-10-10 Tenjin, Fukuoka City, Fukuoka Prefecture) as a new regional hub.

This is part of the regional expansion initiative of INPIT’s functions, promoted by the JPO and INPIT, which aims to ensure that intellectual property, an important management resource, is effectively utilized by regional companies to link innovative products and services to local value creation. The establishment of INPIT-KYUSHU is the second regional hub established nationwide, following “INPIT-KANSAI” in the Kinki region.

INPIT-KYUSHU aims to support IP management in the Kyushu region and improve the earning power of companies and other entities, mainly by carrying out the activities shown in 1. to 3. below:

  1. Providing sophisticated and prompt hands-on support from “IP Strategy Experts”.
  2. Strengthening cooperation with related organizations responsible for business support, such as local governments, support organizations, and financial institutions, including the “IP Management Support Network”, to promote wide-area and comprehensive business support.
  3. Working to improve IP literacy, such as by communicating the importance of IP utilization in academia to local universities and research institutions.

The “IP Strategy Experts” described in 1. above are professional support personnel who possess knowledge of advanced IP strategies and abundant practical experience.

The “IP Management Support Network” described in 2. above is a network established by five parties, i.e. the JPO, the Small and Medium Enterprise Agency, INPIT, the Japan Patent Attorneys Association, and the Japan Chamber of Commerce and Industry, to strengthen and enhance IP management support for regional small and medium-sized enterprises and startups.
