令和8年度商標審査の質についてのユーザー評価調査報告書の概要

特許庁は、「令和8年度 商標審査の質についてのユーザー評価調査報告書」(令和8年9月公表)を取りまとめた。本調査は、令和7年度に特許庁が行った商標審査全般の質について、出願人や代理人等のユーザーから直接評価および意見を収集し、今後の審査業務の改善に役立てることを目的としている。

商標審査全般における全体評価

調査報告書によると、令和7年度の商標審査全般に対する全体評価においては、「普通」以上の評価をしたユーザーの割合が96.0%(昨年度:94.3%)となり、大半のユーザーから一定の評価を得ている。

前年度調査と比較すると、「満足」「比較的満足」を合わせた上位評価の割合は51.6%とやや減少したものの、「比較的不満」「不満」の割合も4.1%へと減少した。一方で「普通」と回答したユーザーの割合が増加(44.4%)しており、全体として安定した評価水準を維持しながらも、より一層の品質向上を求める層が中間層(普通)にとどまっている状況がうかがえる結果となった。

高い評価を得た項目

個別項目の中で最も高い評価を得たのは、「電話や電子メール、面接等における審査官とのコミュニケーション」に関する項目である。本項目は、特許庁が掲げる目標値(上位評価割合65%以上)を大きく上回る結果となった。

  • 「普通」以上の評価割合:96.5%
  • 上位評価(満足+比較的満足)割合:81.4%

引き続き優先的に注力すべき項目

各評価項目の平均値分析および全体評価との相関分析に基づき、以下の3項目が「引き続き優先的に注力すべき項目」として抽出されている。

  • 識別性の判断(上位評価割合:46.5%)
  • 審査官間の判断の均質性(上位評価割合:37.4%)
  • 審判決との均質性(上位評価割合:38.8%)

これらの項目は、全体評価に対する影響度が非常に高いにもかかわらず、上位評価割合が30%~40%台にとどまっており、ユーザーの不満や懸念が集中している領域である。

ユーザーからの指摘事項および具体的課題

商標法第3条(識別性)に関する指摘

自由記入コメントや不満理由の回答において、最も指摘が多く見られたのは「識別性の判断」に関する事項である。不満と回答したユーザーの8割以上が、商標法第3条(商標登録の要件・識別性)の適用および判断をその理由として挙げている。

審査官間の判断のばらつき(均質性)に関する指摘

審査官ごとの判断の差異についても多くの指摘が寄せられている。特に、商標法第3条の識別性の判断と商標法第4条11号の類似性の判断の適用に際して判断のばらつきを感じる場面が多いと報告されており、担当する審査官によって拒絶理由通知のハードルや反論に対する受け止め方に差があることが、出願実務における予測可能性を低下させている要因として挙げられている。

今後の商標審査業務において注力すべき項目

本調査において、ユーザーに対し「今後の商標審査のさらなる充実に向けて、特許庁が特に注力すべき項目」を尋ねたアンケート結果では、「審査における判断の均質性」が40%と最も多く占め、次点の「審査における判断・理解」の27%を大きく上回る結果となった。全体の約4割のユーザーが「判断の均質性」を最優先課題として挙げている事から、審査官の主観に左右されない一貫した審査基準の運用が強く求められている。

今後の対応策および改善への取り組み

特許庁は、今回の評価調査結果およびユーザーから寄せられた具体的な意見を深く分析した上で改善措置を実行する方針を固めており、今後の特許庁での審査の質の向上が期待される。

政府、生成AI事業者向け「プリンシプル・コード」を公表、10月から届出受付

知的財産戦略本部は、2026年8月25日、「生成AIの適切な利活用等に向けた知的財産の保護及び透明性に関するプリンシプル・コード」を公表した。生成AIの開発者・提供者に、学習データ等の概要の開示と、権利者等からの照会への回答を求めるもので、これを受け入れた事業者からの届出は同年10月26日から受け付けられる。

対象は、生成AIシステムを構築して公衆に提供する「生成AI開発者」と、これを組み込んだサービスを公衆に提供する「生成AI提供者」で、日本向けに提供する海外事業者も含まれる。なお、単一の法人・企業グループ内のデータのみで構築し、その範囲にのみ提供するシステムや、第三者の権利を侵害する生成物が生成されるおそれが著しく低いシステムは、対象外とされている。

原則は3つである。①使用モデル・学習データ・クローラ等の概要と、知的財産権保護のための取組状況を自社サイトで開示すること、②訴訟等の法的手続を行い又は準備している権利者から、指定するURL等が学習データに含まれるかの照会を受けた場合に回答すること、③生成AIの利用者から、自らの生成物と同一・類似のコンテンツが掲載されたURL等が学習データに含まれるかの照会を受けた場合に回答すること(当該利用者が訴訟等の手続に用いない旨を誓約していることが要件で、原則②と異なり法的手続の準備は求められない)。

コードに法的拘束力はない。受け入れた事業者は、各原則への対応状況を自社サイトで公表したうえで内閣府に届け出ると、届出事業者の一覧として公表される。届出は内閣府知的財産戦略推進事務局所定の様式によるが、届出先等の詳細は届出開始日(10月26日)に併せて公表される予定である。内閣府は届出内容を審査しないが、一覧により各社の対応の有無が可視化されることになる。

■コンプライ・オア・エクスプレイン

原則を一律に義務づけるのではなく、実施しない場合に理由の説明を求める手法で、コーポレートガバナンス・コード等で用いられている。本コードは著作権法を改正するものではなく、AI学習に関する著作権法第30条の4等の規律は従来どおりである。

新たな保護対象についての意匠登録出願動向

特許庁HPに、改正意匠法(令和2年4月1日施行)に基づく新たな保護対象について出願動向が公表された。これによると、新たな保護対象となった「画像」、「建築物」、「内装」の意匠、また、関連意匠制度の拡充により本意匠の意匠公報発行後(基礎意匠の出願から10年を経過する日前まで)の関連意匠の出願件数は以下のとおりである(ハーグは除く)。

特許庁HPによると、これらの意匠の出願状況については、多くの企業等から高い関心が示されているとのことで、当所のニュースレターにおいても、引き続き掲載していきたい。

Summary of Fiscal Year 2026 Report on User Evaluation Survey on Trademark Examination Quality

The Japan Patent Office (JPO) has compiled the “Fiscal Year 2026 Report on the User Evaluation Survey on Trademark Examination Quality” (published in September 2026). This survey aims to collect direct evaluations and opinions from users, such as applicants and agents, regarding the overall quality of trademark examinations conducted by the JPO in fiscal year 2025, and to utilize them for improving future examination operations.

Overall Evaluation of Trademark Examinations as a Whole

According to the survey report, in the overall evaluation of trademark examinations as a whole for fiscal year 2025, the percentage of users who gave an evaluation of “Neutral” or higher was 96.0% (previous year: 94.3%), showing that the majority of users have a certain level of appreciation.

Compared to the previous year’s survey, although the ratio of high evaluations (combining “Satisfied” and “Somewhat Satisfied”) slightly decreased to 51.6%, the ratio of “Somewhat Dissatisfied” and “Dissatisfied” also decreased to 4.1%. On the other hand, the ratio of users who responded “Neutral” increased (44.4%), suggesting a situation where, while maintaining a stable evaluation level as a whole, the segment of users seeking further quality improvement remains in the middle tier (neutral).

Items that Received High Evaluations

Among the individual items, “communication with examiners through telephone, email, interviews, etc.” received the highest evaluation. This item significantly exceeded the target value set by the JPO (top-tier evaluation ratio of 65% or more).

  • Ratio of high evaluations (Satisfied + Somewhat Satisfied): 81.4%

Items that should Continue to Receive Priority Focus

Based on the analysis of the average values of each evaluation item and the correlation analysis with the overall evaluation, the following three items have been selected as “items that should continue to receive priority focus.”

  • Determination of distinctiveness (high evaluation ratio: 46.5%)
  • Consistency of determinations among examiners (high evaluation ratio: 37.4%)
  • Consistency with appeal/trial decisions (high evaluation ratio: 38.8%)

Despite having a very high level of influence on the overall evaluation, these items remain at high evaluation ratios in the 30% to 40% range, making them areas where user dissatisfaction and concerns are concentrated.

Matters Pointed Out by Users and Specific Issues

Matters Pointed Out Regarding Article 3 of the Trademark Act (Distinctiveness)

In the free-form comments and reasons for dissatisfaction, the most frequently pointed out matter was regarding the “determination of distinctiveness.” More than 80% of the users who responded as dissatisfied cited the application and determination of Article 3 of the Trademark Act (Requirements for Trademark Registration / Distinctiveness) as their reason.

Matters Pointed Out Regarding Variations in Determinations Among Examiners (Consistency)

Many points were also raised regarding differences in determinations among individual examiners. In particular, it is reported that there are many instances where users feel inconsistency in determinations when applying the determination of distinctiveness under Article 3 of the Trademark Act and the determination of similarity under Article 4, Paragraph 1, Item 11 of the Trademark Act. The fact that there are differences in the hurdles of Notices of Reasons for Refusal and the receptiveness to arguments depending on the examiner in charge is cited as a factor lowering predictability in application practice.

Items to Focus on in Future Trademark Examination Operations

In this survey, in response to a questionnaire asking users about “items that the JPO should focus on in particular toward further enhancement of future trademark examinations”, “consistency of determinations in examination” accounted for the largest share at 40%, significantly exceeding “determinations and understanding in examination” in second place at 27%. Since approximately 40% of all users cited “consistency of determinations” as the highest priority issue, there is a strong demand for the operation of consistent examination guidelines that are not influenced by the subjectivity of examiners.

Future Countermeasures and Efforts for Improvement

The JPO has established a policy to implement improvement measures after deeply analyzing the results of this evaluation survey and the specific opinions received from users, and improvements in the quality of examinations at the JPO in the future are expected.

Government Releases “Principle Code” for Generative AI Businesses with Notifications to Be Accepted from October

On August 25, 2026, the Intellectual Property Strategic Headquarters released the “Principle Code on the Protection of Intellectual Property and Transparency for the Appropriate Utilization of Generative AI.” This code requests developers and providers of generative AI to disclose outlines of training data, etc., and to respond to inquiries from right holders, etc. Notifications from business operators who have accepted this code will be accepted starting October 26 of the same year.

The targets are “Generative AI Developers” who build generative AI systems and provide them to the public, and “Generative AI Providers” who provide services incorporating these systems to the public, which also includes foreign business operators providing services for Japan. Systems built using only data within a single corporation or corporate group and provided only within that scope, and systems with an extremely low risk of generating outputs that infringe the rights of third parties, are excluded from the scope.

There are three principles: (1) to disclose on their own website an outline of the models used, training data, crawlers, etc., and the status of initiatives for protecting intellectual property rights; (2) to respond when receiving an inquiry from a right holder who is taking or preparing legal procedures such as litigation, asking whether specified URLs, etc. are included in the training data; and (3) to respond when receiving an inquiry from a user of generative AI, asking whether URLs, etc. where content identical or similar to their own outputs is posted are included in the training data (on the condition that the user pledges not to use it for procedures such as litigation, and unlike principle (2), preparation for legal procedures is not required).

The code is not legally binding. Business operators who have accepted it will publish the status of their compliance with each principle on their own website and then notify the Cabinet Office, after which they will be published in a list of notifying business operators. Notifications shall be made using the form prescribed by the Intellectual Property Strategic Program Office of the Cabinet Office, but details such as the submission destination are scheduled to be published in conjunction with the start date of notifications (October 26). Although the Cabinet Office will not examine the contents of the notifications, the existence of each company’s response will be visualized through the list.

■ Comply or Explain

This is a method that, rather than uniformly mandating principles, requires an explanation of the reasons when they are not implemented, and is used in corporate governance codes, etc. This code does not amend the Copyright Act, and the regulations of Article 30-4, etc. of the Copyright Act concerning AI training remain as before.

Trends in Design Registration Applications for New Subjects of Protection

The trends in applications regarding new subjects of protection under the Revised Design Act (enforced on April 1, 2020) have been published on the JPO website. According to the published trends, the number of design applications for “graphic images,” “buildings,” and “interiors,” which were made new subjects of protection, and the number of applications for related designs after the publication of the design gazette of the principal design (up to 10 years from the filing date of the basic design) due to the expansion of the related design system, are as follows (excluding Hague applications).

According to the JPO website, many companies and other entities have shown high interest in the application status of these designs, and so we will continue to include this information in our newsletter.
