ラオス商工省知的財産局に対する特許審査実務研修

２０２６年９月７日から9日の計３日間、日本国特許庁（JPO）による、ラオス商工省知的財産局（DIP）の職員に対する特許審査実務に関する対面形式での研修が実施された。

前記研修では、JPOの特許審査の実務経験が豊富な国際研修指導教官を含む2名の講師から、ラオスDIPの職員20名の受講者に対して、ケーススタディを通して、主に、新規性および進歩性の判断について講義等が行われた。

また、今後も、ラオスDIPに対するJPOの特許審査実務研修は継続的に行われる見込みである。

よって、将来的に、ラオスにおける特許審査、特に新規性および進歩性の判断にて、日本と同様の判断がされ、日本で特許となった発明について、ラオスでも問題なく特許を取得できるようになると考えられる。

日本国特許庁とベトナム国家知的財産庁におけるバイ会談

２０２６年１０月２日に、日本国特許庁（JPO）の野仲特許技監と、ベトナム国家知的財産庁（IPVN）のルー・ホアン・ロン長官との間でバイ会談が実施された。

前記バイ会談では、特許審査ハイウェイ（PPH）等の特許審査協力など、今後の両庁間の協力について意見交換が行われた。

また、JPOは、今後もIPVNとの間の知的財産分野における協力をより一層進めていくとの意向を示している。

よって、例えば、日本での審査結果に基づくベトナムへのPPHの申請に関するPPH試行プログラムについて、試行期間の終了日が現在の２０２８年３月３１日から延長される等、JPOとIPVNとの間の協力関係は今後も継続されていくと考えられる。

改正された審判便覧の公表

日本国特許庁は、審判に関する法改正等に対応して、審判便覧の内容を、適宜、見直して改定し、当該改定の内容を公表してきた。

このたび、２０２６年１０月１日に、民事訴訟法等の一部を改正する法律（令和4年法律第48号）の施行に伴い、電磁的記録に記録された情報の内容に係る証拠調べが整備されたこと等に対応して改正された審判便覧が公表された。

前記改定後の審判便覧および前記改定の具体的な内容を、特許庁HP（https://www.jpo.go.jp/system/trial_appeal/sinpan-binran.html）からダウンロードすることが可能である。

今後、主に、審判を請求し、証拠として、電磁的記録に記録された情報、例えば、ウェブ会議システムなどを利用した尋問の録音・録画データをそのまま記録した電磁的記録媒体を証拠として提出する場合、改正された審判便覧を確認して適切な手続きを行うことが重要である。

知的財産権所有者協会の年次総会

２０２６年９月２７日から２９日にかけて、カナダのトロントにおいて、知的財産権所有者協会（IPO）主催の年次総会が開催された。日本国特許庁（JPO）からは松下審査第三部長が参加し、アジア実務委員会において、AI支援発明の「発明者」論点の検討状況、AI関連発明の審査、特許審査におけるAI活用、JPO AIビジョン等に関するJPOの取組が紹介された。

よって、今後、JPOにて、AIを利用した審査の迅速化が進む見込みである。また、AI関連発明の審査の効率も向上し、AI関連発明の特許の件数も増加すると考えられる。

さらに、前記年次総会では、JPOと、IPO、カナダ知的財産庁（CIPO）および米国企業との間で意見交換も行われた。

よって、今後、日本国と、カナダおよびアメリカとの間の知的財産権に関する協力関係もさらに推進されると考えられる。

Patent Examination Practice Training for the Department of Intellectual Property, Ministry of Industry and Commerce of Laos

For a total of three days from September 7 to 9, 2026, the Japan Patent Office (JPO) conducted in-person training on patent examination practice for officials of the Department of Intellectual Property (DIP), Ministry of Industry and Commerce of Laos.

In this training, two instructors, including an International Training Instructor with extensive practical experience in patent examination at the JPO, delivered lectures and sessions mainly on the determination of novelty and inventive step through case studies to 20 participating officials of the Lao DIP.

Furthermore, it is expected that the JPO will continue to provide patent examination practice training to the Lao DIP in the future.

Therefore, it is considered that in the future, patent examinations in Laos will be conducted in the same manner as in Japan, especially regarding the determination of novelty and inventive step, thus enabling inventions patented in Japan to be smoothly patented in Laos as well.

Bilateral Meeting Between the Japan Patent Office and the Intellectual Property Office of Vietnam

On October 2, 2026, a bilateral meeting was held between Matsuo Nonaka, Deputy Commissioner of the Japan Patent Office (JPO), and Director General Luu Hoang Long of the Intellectual Property Office of Vietnam (IPVN).

During the bilateral meeting, opinions were exchanged regarding future cooperation between the two offices, such as patent examination cooperation including the Patent Prosecution Highway (PPH).

In addition, the JPO expressed its intention to further advance cooperation with IPVN in the field of intellectual property.

Therefore, it is expected that the cooperative relationship between the JPO and IPVN will continue, such as by extending the PPH pilot program regarding PPH applications to Vietnam based on Japanese examination results beyond the current end date of March 31, 2028.

Publication of the Revised Manual of Trial and Appeal Proceedings

The Japan Patent Office has periodically reviewed, revised, and published the contents of the Manual of Trial and Appeal Proceedings in response to legislative amendments concerning trials and appeals.

On October 1, 2026, a revised Manual of Trial and Appeal Proceedings was published in response to developments such as the establishment of rules for taking of evidence concerning information recorded in electronic or magnetic records, which accompanied the enforcement of the Act for Partial Revision of the Code of Civil Procedure, etc. (Act No. 48 of 2022).

The revised Manual of Trial and Appeal Proceedings and the specific details of the revisions can be downloaded from the JPO website (https://www.jpo.go.jp/system/trial_appeal/sinpan-binran.html).

Going forward, particularly when requesting a trial or appeal and submitting as evidence information recorded in electronic or magnetic records, such as an electronic or magnetic recording medium containing raw audio or video data of an interrogation conducted via a web conferencing system, it will be important to refer to the revised Manual of Trial and Appeal Proceedings and carry out appropriate procedures.

Annual Meeting of the Intellectual Property Owners Association

From September 27 to 29, 2026, the Annual Meeting hosted by the Intellectual Property Owners Association (IPO) was held in Toronto, Canada. From the Japan Patent Office (JPO), Koichi Matsushita, Director-General of the Third Patent Examination Department, participated in the meeting. Mr. Matsushita introduced the JPO’s initiatives at the Asian Practice Committee regarding the status of discussions on the “inventorship” issue for AI-assisted inventions, examination of AI-related inventions, utilization of AI in patent examination, the JPO AI Vision, and other related topics.

Accordingly, it is anticipated that the JPO will further accelerate examinations utilizing AI going forward. In addition, the efficiency of examining AI-related inventions is expected to improve, leading to an increase in the number of patents for AI-related inventions.

Furthermore, during the Annual Meeting, opinions were also exchanged between the JPO, the IPO, the Canadian Intellectual Property Office (CIPO), and US companies.

Therefore, it is considered that cooperative relationships regarding intellectual property rights between Japan, Canada, and the United States will be further promoted in the future.
