特許出願非公開制度について
特許出願非公開制度については本ニュースレターでも何度か紹介してきましたが、いよいよ本年5月1日から開始されます。特許庁もすでに詳細な情報を公開してきていますが、本年2月2日には、特許庁が行う第一次審査と外国出願禁止の事前確認制度についての解説が発表されています。以下はその前置きの引用ですが、特許出願非公開制度のフロー図も含めた解説の詳細は下記から特許庁の「特許出願非公開制度について」をご覧下さい。

「令和6年5月1日より、経済安全保障推進法（以下、「法」といいます。）に基づいて、特許出願非公開制度（以下、本制度といいます。）が開始されます。本制度は、特許出願の明細書等に、公にすることにより外部から行われる行為によって国家及び国民の安全を損なう事態を生ずるおそれが大きい発明が記載されていた場合には、「保全指定」という手続により、出願公開、特許査定及び拒絶査定といった特許手続を留保するものです。
特許出願を非公開にするかどうか（保全指定をするか否か）の審査は、特許庁による第一次審査と内閣府による保全審査（第二次審査）の二段階に分けて行われます。また、本制度開始後は、一定の場合に外国出願（特許協力条約に基づく国際出願、すなわちPCT出願も含まれます。）が禁止されますので、外国出願禁止の対象となるか事前に特許庁長官に確認を求める制度（外国出願禁止の事前確認）も新設されます。
このページでは、本制度において特許庁が行う第一次審査及び外国出願禁止の事前確認制度を中心にご説明いたします。また、必要に応じてQ&Aもご参照ください。なお、本制度一般、保全審査、保全指定後に関する事項（実施の許可、適正管理措置、損失補償等）については、内閣府のホームページ（外部サイトへリンク）をご参照ください。」
オンラインで受け取り可能な書類
特許庁によると、４月１日より、これまで書面でしか受け取れなかった書類のうち、以下の７書類が出願ソフトでオンライン受領可能になる予定とのことです。対象となる書類は以下のとおりです。
（１）特許（登録）証
（２）年金領収書
（３）自動納付関係通知
（４）商標更新申請登録通知
（５）移転登録済通知
（６）識別番号通知
（７）包括委任状番号通知
ただし、オンラインによる受領を希望する人は、インターネット出願ソフトでその設定をする必要があります。また、取得方法についても注意すべき事項がありますので、下記のURLから情報を入手して下さい。

特許情報プラットフォームの機能改善について
特許庁が運用する特許情報プラットフォーム（J-PlatPat）の一部の機能が、本年２月２６日から改善される予定とのことです。改善される主な機能は、以下のとおりとのことです。
（１）商標検索及び審決検索における人名検索が、完全一致検索から部分一致検索に変更される。
（２）特許・実用新案検索、意匠検索、商標検索及び審決検索において、入力した検索条件を５件まで保存できるようになる。また、必要に応じてＣＳＶ形式での検索条件のインポート・エクスポートが可能になる。
（３）文献固定アドレスのランダム値部分をなくし簡素化（アドレスを短縮）する。なお、本機能リリース後も従前の文献固定アドレスは利用可能。
（４）経過情報の「分割出願情報」タブに、特許・実用新案の公開系公報の番号が追加される。

System for Non-disclosure of Patent Applications
The System for Non-disclosure of Patent Applications, which has been mentioned several times in this newsletter, will finally start on May 1 of this year. The JPO has already released detailed information, and on February 2 of this year, an explanation of the JPO’s system of Primary Review by the JPO and the system of Prior Confirmation Regarding Prohibition of Foreign Applications was published. “On May 1, 2024, the system for non-disclosure of patent applications (hereinafter referred to as the “System”) will be introduced under the Economic Security Promotion Act (hereinafter referred to as the “Act.”) Under the System, if the description etc., of a patent application includes an invention that, if made known to the public, would be highly likely to create a situation to undermine the security of the nation and its citizens through actions taken from the outside, the patent procedures, such as publication of the application, decision of patent grant and decision of refusal, are suspended by a procedure established as “security designation.”
A review of whether a patent application should be kept non-disclosed (whether a security designation should be made or not) is carried out in two stages: a primary review by the JPO and a security review (a secondary review) by the Cabinet Office. In addition, after the introduction of the System, foreign applications (including international applications pursuant to the Patent Cooperation Treaty, i.e., PCT applications) are prohibited in certain cases. Therefore, the system that seeks a prior confirmation from the Commissioner of the JPO as to whether or not the foreign application is prohibited (Prior Confirmation Regarding Prohibition of Foreign Applications) is newly provided.

Documents Receivable Online
According to the JPO, as of April 1, the following seven documents, which could previously only received by letter, will be available for online receipt via the application software. The documents are as follows:
(1) Patent (registration) certificates
(2) Annuity receipts
(3) Automatic payment notices
(4) Notifications of registrations of trademark renewals
(5) Notifications of registrations of transfers
(6) Notifications of identification numbers
(7) Notifications of General Power of Attorney numbers
However, those who wish to receive these documents online must make such settings in their online application software. There are also some matters to be noted regarding the method of obtaining the documents, regarding which information is available from the following URL:

Improvement of Functions of the Japan Platform for Patent Information
Some functions of the Japan Platform for Patent Information (J-PlatPat) operated by the Japan Patent Office (JPO) will be improved from February 26 this year. The main functions to be improved are as follows:
(1) Person search in trademark search and trial decision search will be changed from exact match search to partial match search.
(2) Up to 5 search conditions can be saved in the patent/utility model search, design search, trademark search, and trial decision search. In addition, search conditions can be imported and exported in CSV format if necessary.
(3) The random value portion of fixed addresses of documents will be eliminated and simplified (shortening of the addresses). The existing fixed addresses will still be useable after the release of this feature.
(4) Publications numbers (before examination) of patents and utility models will be added to the “Divisional Application Information” tab in the Details (history information) page.
